Porn Resolution OK'd By County

In an attempt to regulate sexually oriented businesses in Kosciusko County, county commissioners Tuesday approved an amendment to the zoning ordinance Monday.
The amendment does not prohibit sexually oriented businesses or restrict access by adults to sexually oriented businesses. However, it does limit their location, spell out what kinds of businesses are classified as sexually oriented, and list violations and exemptions.
Sexually oriented businesses are classified as adult arcades, adult bookstores or video stores, adult cabarets, adult motels, adult theaters, nude model studios and sexual encounter centers.
The location of these businesses is limited to areas that are zoned commercial, and they cannot be located within 1,000 feet of a church, school, boundary of a residentially zoned district, public park or daycare center.
They also cannot be located within 1,000 feet from other sexually oriented businesses.
Work on the ordinance amendment began several months ago, said Tonya Ford, assistant planner for Kosciusko County. Earlier this year South Bend enacted an ordinance regulating sexually oriented businesses, and Kosciusko County officials were concerned that those businesses would migrate to Kosciusko County.
The ordinance amendment required extensive research, she said, and was presented to the county plan commission last week. The plan commission unanimously recommended approval by the county commissioners.
No remonstrators opposed the amendment at the commissioners' meeting, and Ford said no one spoke against it at the plan commission meeting.
The ordinance effective date was Nov. 10.
In other business, the commissioners:
• Unanimously approved recommending the county council grant $74,145 to the Local Coordinating Council of the Governor's Commission for a Drug-Free Indiana, for its 1998 programs.
• Agreed to ask the postmaster to send a letter to Tippecanoe Township residents of EMS addresses that warns them they must comply with address requirements or risk not having their mail delivered. The action was in response to a request by Tippecanoe Township trustee Dick Mitchell.
• Approved a service contract for heating and air conditioning equipment with Trane. The full-service contract will cost $19,995.
