Planners Vacate Streets Around Lilly Property

The Area Plan Commission approved a petition to vacate lots, streets and public rights of way as filed by Eli Lilly II, Ruth Virginia Lilly Nicholas, Irene Katherine Lilly McCutchen and Turkey Creek Holdings & Wawasee RR Holdings (Case No. 06001PV) Wednesday.

Lots 12 through 25 in Eli Lilly's second plat of Wawasee & Country Club Acres Phase I is along Lake Wawasee in Turkey Creek Township, south of the relocated Eli Lilly Road.

The request, presented by lawyer Steve Snyder, is the final step of a project started in 2000. Since then Eli Lilly Road was reconstructed away from the lake.

The new road runs south of the railroad tracks, from Warner to Bishop Road, just south of the railroad crossing.

The old road is closed and privately maintained.

There are three houses on the property, those of the petitioners.

Board member Larry Coplen asked if the land shouldn't be platted and Plan Commission Director Dan Richard said there would be plats if any of the property was sold off in the future.

The move essentially triples the land "behind" the houses. The action reduces a hodgepodge of 40 non-conforming tracts to nine tracts.

In another matter, the board approved, and will recommend to the county commissioners, several ordinance changes. They are:

• Adding auto service and repair as an excepted use in a light industrial zone.

• Increasing the minimum square footage in residential and agricultural districts, without sewer service, from 15,000 square feet to 20,000 square feet. The minimum lot size per family in residential and agricultural zones was increased from 5,000 square feet to 10,000 square feet.

Kosciusko County Health Department Administrator Bob Weaver appeared to talk about the increases.

"Our board thinks it's a very good idea," he said, adding that people often want to add an addition or build an auxiliary building or want to install a pool and find out their land is used up with the septic field.

• Reducing the setbacks on lots with a public sewer from 30 feet to 25 feet.

• Adding satellite receivers and antennas no more than 2 feet in diameter to items not requiring an improvement location permit, under certain conditions.

The plan commission also:

• Approved a final plat request by Alberta Wamsley (Case 05015SD) of lot A in Thorn Tree Hill. The property is on the northeast side of Chapman Lake at 3418E CR 400N in Plain Township.

• Approved a preliminary plat by KBB Development (Case 06001SD) for a residential development on 1.377 acres. The property is on the northwest corner of Fox Run Drive and Syracuse Webster Road in Turkey Creek Township.

Commissioner Kevin McSherry advised the board of an upcoming auction along CR 400W off Crystal Lake Road. The tracts run along or near the proposed "western bypass" and should be zoned industrial or commercial.

His concern was someone would plan houses there without knowing about the proposed road.
