Planners Table Vacation Request

Warsaw Plan Commission Monday tabled a request for a public way vacation east of Boydston's Addition in Warsaw.

Petitioner Tony Lloyd, Patten Monument president, requested the public way vacation. The alley Lloyd requested be vacated is north of Patten Monument, 633 S. Buffalo St.[[In-content Ad]]The commission will need to make a favorable or unfavorable recommendation to Warsaw City Council for the vacation.

The public way or alley is the only access to lot 14 and 15 of Boydston's addition, and one of four accesses to a 10-acre parcel to the east of Lloyd's property, according to City Planner Jeremy Skinner.

While both properties have wetland issues, the alley is a major point of ingress and egress for those two lots, Skinner said.

There also is a utility pole and easement that runs north, and an easement that runs north and south through the alley.

Lloyd showed the commission aerial photos of property on both sides of the east half of the alley that he is requesting to vacate.

"Without the alley being vacated it is hard for my business to get semis in and out to unload items," Lloyd said.

"I have been wanting the alley vacated for years because I have maintained the alley," Lloyd said.

Good To Go gas station, South Buffalo Street, owned by Don Good, is to the north of the west half of the alley Lloyd is proposing be vacated.

Skinner said Lloyd needs to discuss with Good whether he would have an objection to the total alley being vacated, and selling Good's part of the alley to Lloyd.

"At this point, if the city approved the alley being vacated, Good would own half of the alley and Lloyd would own the other half," Skinner said.

Lloyd said he would like ownership of the whole alley.

Ed Oliver also owns property northeast of the alley Lloyd requested be vacated, and Skinner said Lloyd needs to discuss whether Oliver would support the alley being vacated.

"We need to make sure we are not landlocking the property," said commissioner Jeff Grose.

The commission will again discuss the proposed vacation at its April 14 meeting.

Commissioners are Tom Allen, Tammy Dalton, Jim Gast, Lacy Francis, Rick Keeven and council representatives Grose and Joe Thallemer.
