Section 1 - BIDDING AND CONTRACT REQUIREMENTS
INSTRUCTIONS TO BIDDERS
1.    Project Title:        New Pavilion for the City of Nappanee
2.    Owner:    City of Nappanee, Indiana (the “City”)
                        300 West Lincoln Street – P.O. Box 29
                        Nappanee, Indiana 46550-0029
3.    Project Description:    construction and erecting of structural steel
                    framed community pavilion.  Finished pavilion
                    shall be by code an A3 occupancy of type II-B
                    construction.  The building shall contain
                    Nine-Thousand-Seven-Hundred-Fifty square feet.
4.    Invitation to Bid:
    A.    The City reserves the right to reject any and all bids received.
    B.    Bids will be received by the City at the City Offices until 6:00                     P.M. local time Monday, August 3, 2015.
    C.    All  bidders  are  to  use the Bid Form furnished herein together                 with  those  further  documents  referenced  herein  or otherwise             required  by  applicable  Indiana statute. Additional information              may be provided.
5.    Notice to Bidders:
    Proposed construction of Community Pavilion by the City of Nappanee,     Indiana.
    The City of Nappanee is soliciting building proposals for the construction of a new community pavilion to be located at 201 W. Market St., Nappanee, Indiana.  The proposal shall be for the construction of the community pavilion as specified.
    Generally stated, this project involves the construction and erecting of a structural steel framed community pavilion for the City of Nappanee.  The pavilion area when completed shall be nine thousand seven hundred fifty (9,750) square feet.  The pavilion shall include Concrete foundations, structural steel framing including three cupolas, finished elevations and electrical.  There shall be no mechanical or plumbing systems.  The drawings and specifications for this proposed pavilion are on file in the offices of the City of Nappanee, 300 West Lincoln Street, Nappanee, Indiana. Two sets of blueprints and one set of specifications are available for a non-refundable fee of $25.00 at the City offices.
    The bidder must prominently note all exceptions to the general specifications.
    Each bidder's bid proposal shall include a bid bond in the amount of     five (5) percent of the amount of such bid.
    The formal bids are to be opened by the City of Nappanee on the 3rd   day of August, 2015 at 6:00 p.m. at the meeting of the City of Nappanee Board of Public Works and Safety which is open to the general public and held in the Council meeting room in the offices of the City.  All bids must be received at or before 6:00 p.m. on the 3rd day of August, 2015 in the offices of the City of Nappanee, 300 West Lincoln Street, Nappanee, Indiana 46550-0029.  All bids received after such time shall be returned unopened. Each bid submitted to the City shall be in sealed envelopes marked with the name and place of business of the bidder.
    Pursuant to I.C. 36-1-12-6, the City reserves the right to hold all bids, and to bind all bidders until action thereon, for a period of Sixty (60) days.  The City reserves the rights to reject all bids submitted; to accept the bid of the lowest responsible and responsive bidder; and to waive any and all informalities in bidding.
    If the bid of a party exceeds One Hundred Fifty Thousand Dollars ($150,000.00), the bidder must submit a financial statement, a statement of experience, its proposed plan or plans for performing the public work, and equipment that such party has available for the performance of the public work.  The statement shall be submitted on forms prescribed by the State Board of Accounts of the State of Indiana, which form     should also contain, when submitted, a signed non-collusion affidavit.
    If a contract is awarded to a bidder at a price in excess of Two Hundred Thousand Dollars ($200,000.00), retainage/escrow arrangements     per I.C. 36-1-12-14 shall apply.
    The successful bidder will be expected to enter into a contract with the City in the form available for inspection in the offices of the     City of Nappanee, 300 West Lincoln Street, Nappanee, Indiana. Said contract will require that the successful bidder commence construction within sixty (60) days after notice to proceed from the City of Nappanee, or its representatives provided however, that no commencement of construction shall occur before September 22, 2015.     The     contractor shall have ninety (90) days from the date of commencement of construction within which to complete the project. A     performance bond equal to the contract price and a payment bond to     insure the payment of subcontractors, contract laborers, material     suppliers, and persons furnishing services, also in the amount of the     contract price, will be required upon award of the contract.
    This "Notice to Bidders" forms a part of the "Specifications for the Community Pavilion” for the City of Nappanee, and each bidder     is
expected to be knowledgeable of the provisions of the     "Specifications" including this "Notice".
