HARRY CRACE, EDATH CRACE, MERS INC. solely as nominee for TMS Mortgage, Inc. and BENEFICIAL INDIANA, INC., Defendants IN THE KOSCIUSKO SUPERIOR COURT CIVIL DIVISION CAUSE NO. 43D03-0807-MF-00766 NOTICE This communication is from a debt collector and is an attempt to collect a debt, any information obtained will be used for that purpose. The State of Indiana to the defendants named above, and any other concerned person, You are notified that you have been sued in the Court above named. The nature of the suit against you is: SUIT ON MORTGAGE AND ON RETAIL INSTALLMENT CONTRACT AND SECURITY AGREEMENT: The plaintiff complains that Harry Crace and Edath Crace have breached the terms of both a Retail Installment Contract and Mortgage entered by and among them and the plaintiff on or about August 17, 1998 wherein they promised but failed to make repayment of a purchase money loan secured by the following property owned by them: a 1999 Fortune Mobile Home, 28x64, Serial Number 20028R and appurtenances as well as: Part of the West half of the Northwest Quarter of. Section 9, Township 30 North, Range 5 East, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at P. K. nail found over a buried railroad spike at the Southwest corner of said Northwest Quarter; thence North 00 degrees 00 minutes East (desc bearing), on and along the West line of said Northwest Quarter, a distance of 579.17 feet to a P.K nail at the true point of beginning; thence continuing North 00 degrees 00 Minutes East, on and along said West line, being with the right-of-way of County Road 200W, a distance of 323.75 feet to a PK nail; thence North 89 degrees 46 minutes 38 seconds East, a distance of 1306.74 feet to an iron pin on the East line of the West half of said Northwest Quarter, thence South 00 degrees 08 minutes 42 seconds West, on and along said East line, a distance of 323.75 feet to an iron pin found; thence South 89 degrees 46 minutes 38 seconds West, a distance of 1305.92 feet to the true point of beginning. More commonly known as 11370 S. 200, Silver Lake, IN 46982. This Summons by publication is specifically directed to the following named defendants whose address and whereabouts is unknown: MERS, Inc. Soley as nominee for TMS Mortgage Inc., The Money Store, Beneficial Indiana, Inc., Harry Crace and Edath Crace.
