By virtue of a certified copy of a decree to me directed from the Clerk of Kosciusko Superior Court 3 of Kosciusko County, Indiana, in Cause No. 43D03-1007-MF-620 wherein Beneficial Financial I Inc. was Plaintiff, and Donna M. Hartman and Jack Hartman II were Defendants, required me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 28th day of August, 2012, at the hour of 10:00 am, or as soon thereafter as is possible, at 221 West Main Street, Warsaw, IN 46580, the fee simple of the whole body of Real Estate in Kosciusko County, Indiana.
Lots Numbered 12 and 13 in Hillview Subdivision, according to the Plat thereof, as recorded in Plat Book 5, page 153, in the Office of the Recorder of Kosciusko County, Indiana .Except that part of Lot 13 conveyed to Mary S. Bryan, by Warranty Deed recorded May 11, 1995, as Instrument No. 95-05-0480 and more particularly described as follows: A part of Lot Numbered 13 as said Lot is known and designated on the Record plat of Hill View Subdivision, as recorded in Plat Book 5, at page numbered 153, in the Office of the Recorder of Kosciusko County, Indiana, and being more particularly described as follows, to-wit: Beginning at the Southeast corner of Lot Number 13 as said Lot is known and designated on the Record Plat of Hill View Subdivision, as recorded in Plat Book 5, at page numbered 153, in the Office of the Recorder of Kosciusko County, Indiana (being a found iron rod); thence running Westerly (North 89 degrees 15 minutes 20 seconds West - calculated) along the South line of said Lot Numbered 13, a distance of 130.00 feet (calculated) (being a set iron rod); thence running North 0 degrees 57 minutes 25 seconds East (calculated), a distance of 147.06 feet (calculated) to a point located on the North line of said Lot Numbered 13 (also being a point located on the South right-of-way line of Steele Drive) (being a set iron rod); thence running Easterly (South 89 degrees 19 minutes 12 seconds East (calculated) along the North line of said Lot Numbered 13 (also being the Southerly right-of-way line of Steele Drive), a distance of 128.65 feet (calculated) to the Northeast corner of said Lot Numbered 13 (being a set iron rod); thence running Southerly (South 0 degrees 26 minutes 23 seconds West (calculated)) along the East line of said Lot Numbered 13, a distance of 147.30 feet (record) (147.20 feet calculated) to the aforementioned Point of Beginning.

Together with rents, issues, income and profits thereof, said sale will be made without relief from valuation or appraisement laws.
