TO THE OWNERS OF THE WITHIN DESCRIBED REAL ESTATE AND ALL INTERESTED PARTIES
By virtue of a certified copy of a decree to me directed from the Clerk of the Superior Court of Kosciusko County, Indiana, on Cause No. 43D03-1104-MF-100 wherein Deutsche Bank National Company, As Trustee For Ameriquest Mortgage Securities Inc., Asset-Backed Pass-Through Certificates, Series ARSI2006-M3, was Plaintiff, and Carl L. Momeyer and Tawnya Momeyer, were the Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on February 28, 2012 at the hour of 10:00 a.m., at the Kosciusko County Sheriff's Department, 221 West Main Street, Warsaw, IN 46580, the fee simple of the whole body of Real Estate in Kosciusko County, Indiana.
Tract I: Lots numbered six (6) and seven (7) in Radar's First Addition to River Bend Park, Less and excepting the west 39 feet of said lot seven (7), conveyed by George A. Nye and Glady's R. Nye, his wife, to Arthur C. and Anjeele V. Huffman, by Warranty Deed, dated September 12, 1959, recorded September 15, 1959, in Deed Record 193, page 236, in the Recorder's Office of Kosciusko County, Indiana
Tract 2: A tract of real estate located in the west half of the southwest quarter of section 14, township 33 north, range 6 east, Kosciusko County, Indiana, more particularly described as follows, to wit:
Beginning at the northeast corner of lot number six (6) in Radar's First Addition to River band Park; thence south 84 degrees 45 minutes east (recorded east), on and along the south right-of-way line of Riverside Drive, a distance of 20.0 feet to an iron pipe found; thence south 00 degrees 00 minutes east (recorded south) and parallel to the east line of said lot number six (6), a distance of 116.9 feet (recorded 117 feet, more or less) to the point of intersection with the southeasterly projection of the southerly line of said Radar's First Addition; thence north 66 degrees 47 minutes west (recorded north 69 1/2 degrees west), on and along said southeasterly projection, a distance of 21.6 feet to the southeast corner of said lot number six (6); thence north 00 degrees 00 minutes west (recorded north), on and along said east line, a distance of 110.0 feet to the point of beginning.
