NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing Tuesday, June 10, 2008 at 6:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this Hearing is to hear a variance request, #06-08-BZA, filed by owner Paul D. Miller, 1937 Country Circle South, and purchaser Randy Yoder 27453 CR 150 Nappanee. IN 46550. The request is for a variance from the Nappanee Unified Zoning and Subdivision Control Ordinance to allow the construction of a mini storage facility with a 5 foot side yard set back on the West property line. The Unified Zoning and Subdivision Control Ordinance requires a 10-side yard set back. The property is located at 1800 E. Market St. Nappanee, IN LEGAL DESCRIPTION OF THE PROPERTY: A part of the northwest quarter of section 32, township 35 north, range 5 east, Union Township, Elkhart County. Indiana, being more particularly described as follows: Commencing at a P.K. nail marking the southwest corner of the northwest quarter of said section 32; thence on an assumed bearing of due east along the south line of said northwest quarter, a distance of 300 feet; thence north 00 degrees 15 minutes 40 seconds east parallel with the west line of said northwest quarter, a distance of 150 feet to the point of beginning of this description; thence continuing north 00 degrees 15 minutes 40 seconds east parallel with the west line of said northwest quarter, a distance of 642 feet; thence on a bearing of due east parallel with the south line of said northwest quarter a distance of 172.5 feet; thence south 00 degrees 15 minutes 40 seconds west parallel with the west line of said northwest quarter. a distance of 642 feet; thence on a bearing of due west parallel with the south line of said northwest quarter, a distance of 172.5 feet to the point of beginning of this description containing 2.6542 acres more or less, being subject to all easements, restrictions and public right-of- of record.
