NOTICE OF PUBLIC HEARING Notice is hereby given, that the Kosciusko County Area Plan Commission shall hold a public hearing on a petition filed by Theodore Krammer requesting an amendment to the Wayne Kosciusko County Zoning Ordinance, to reclassify from an Agriculture District to a Commercial District, the following real estate, located: 003-024-003.B an E Side Fox Farm Rd, 261' N of Old Rd 30 (Lake St.) and described as follows, to wit: A parcel of land located in the southeast quarter of section 6, township 32 north, range 6 east, Wayne Township, Kosciusko County, Indiana, more particularly described as follows: Commencing at the intersection of the east right-of-way line of a public road (Fox Farm Road - AKA Kimes Road) and the south line of said southeast quarter, said point being witnessed by a 5/8 inch rebar, said point being north 88'090'23" west (bearing assumed), a distance of 1662.13 feet, from a 5/8 inch rebar located at the southeast corner of said southeast quarter; thence north 9º48'31" east along said east right-of-way line, to the northeast corner of a tract of land as described in Deed Record, instrument number 95-05-0570, as recorded in the office of the Kosciusko County Recorder, a distance of 272.56 feet (5/8 inch rebar), said point being the point of beginning; thence continuing along said east right-of-way line north 10º39'53" east (deed record north 8º48'48" east), a distance of 335.69 feet (5/8 inch rebar); thence south 79º16'43" east, a distance of 264.03 feet (5/8) inch rebar); thence south 10º39'53" west, a distance of 285.91 feet, said point being witnessed by a 5/8 inch rebar set, north 89º57'27" west, along the north line of aforementioned tract, to the point of beginning, a distance of 268.63 feet, containing 1.88 acre more or less. Subject to all easements and covenants of record. This change is requested to permit the above described real estate to be used for the purpose of Commercial uses as defined by the Kosciusko County Zoning Ordinance. The hearing will be held at: Commissioners Room Court on Wednesday, April 1, 2009 at 1:00 pm. All interested persons are invited to attend and be heard.
