NOTICE OF PUBLIC HEARING BY THE CITY OF WARSAW REDEVELOPMENT COMMISSION ON PROPOSED AMENDMENTS TO THE DECLARATORY RESOLUTION AND THE REDEVELOPMENT PLAN FOR THE WARSAW CENTRAL DEVELOPMENT AREA Notice is hereby given that the City of Warsaw Redevelopment Commission (the "Commission") will hold a public hearing on a proposed resolution (the "Proposed Resolution") to amend its Resolution No. 90-2-1, adopted by the Commission on February 21, 1990 (as confirmed by the Commission on September 24, 1990), for the purpose of expanding the currently existing Warsaw Central Development Area (the "Original Area"), by not more than twenty percent (20%) (the area proposed to be added to the Original Area shall hereinafter be referred to as the "Expansion Area"). The Expansion Area is located in the City of Warsaw, Indiana (the "City"). The Expansion Area is described as follows: A tract of land in Section 8, Township 32 North, Range 6 East, Wayne Township, Kosciusko County, Warsaw, Indiana, more particularly described as follows: Beginning at the Northeast corner of Lot #10 in Knott's Addition to the City of Warsaw, as recorded in Plat Book 1, page 3 in the Office of the Recorder in Kosciusko County, Indiana said point being on the West line of Buffalo Street; thence North along said West line and the East line of Lots Numbered 2 thru 8 extended in said Knott's Addition, and the East line of Lots Numbered 1 thru 3 in C.P.. Jacques Addition to the City of Warsaw, as recorded in Plat Book 1, page 17 in the Office of the Recorder in Kosciusko County, Indiana, extended to the waters edge of Center Lake; thence Northeasterly, along said waters edge to the extended West line of Lot Number 10 in said C.P. Jacques Addition; thence Southeasterly along said West line extended and the West line of Lot Number 10 to the Northerly right-of-way of Canal Street (platted Water Road in said C.P. Jacques Addition); thence Southwesterly, along said right-of-way, to the intersection of said right-of-way and the East line of Lot number 8 and the West line of an alley in said C.P. Jacques Addition; thence South, along said West line and along the East line of Lots Numbered 51 thru 58, in said Knott's addition, extended to the Northeast corner of Lot Number 50 in said Knott's Addition; thence West, along the North line of said Lot Number 50, and said North line extended, 214.5 feet, to the Point of Beginning, containing 5,00 acres more or less. Subject to all covenants, easements, or restrictions of record. The Original Area and the Expansion Area are more particularly described as on file in the office of the City Planner, 794 West Center Street, Warsaw, Indiana 46580 (telephone number: 574-372-9550). The Proposed Resolution would further amend the existing Redevelopment Plan for the Warsaw Central Development Area to provide for the expansion of the Original Area as provided above, to provide for certain additional projects, and to add parcels to the list of property to be acquired under the Plan (the "Plan Amendment"). The Proposed Resolution and Plan Amendment would also expand the "allocation area" (as such term is defined in Indiana Code 36-7-14-39) relating to the Original Area so as to include the Expansion Area. The parcels to be added to the acquisition list for the Plan are as follows: Parcel 1 Owner: Indiana American Water Legal Description: SE Corner Lot 5 Jacques Addition Parcel 1 Owner: Indiana American Water Legal Description: Lots 5, 6,7,8 of Jacques Addition Notice is further given that the public hearing will be held on Monday, June 2, 2008, at 12:00 p.m. (local time), in the City Hall Council Chambers, 302 East Marker Street, Warsaw, Indiana, 46580 at which time the Commission will hear all persons interested in the proceedings and consider the objections of any person who has filed a written remonstrance to the proposed amendments within the filing period set forth below and will consider adopting a resolution approving the proposed amendments. Written remonstrance to the proposed amendments must be filed with the Commission at 302 East Market Street, Warsaw, Indiana 46580 by 11:30 a.m. (local time) on Monday, June 2, 2008.
