NOTICE OF PUBLIC HEARING NAPPANEE CITY PLAN COMMISSION The City of Nappanee Plan Commission will hold a Public Hearing Thursday, August 13, 2009 at 7:00 p.m. in the Council Chambers at the Nappanee City Municipal Center, 300 W. Lincoln St, Nappanee, Indiana. The purpose of this hearing is to review the Preliminary Plat of C,Z &M Subdivision being a replat of the Coppes Complex, 401 E. Market Street Nappanee, IN filed by LT Properties, LLC, 257 Haney Drive Nappanee, IN 46550 and Richard Mynsberg, 222 S. 5th Street, Elkhart, IN 46516 owners of property located at 401 E. Market Street Nappanee, IN 46550. LEGAL DESCRIPTION OF PROPERTY: A part of the Southwest Quarter of Section 31, Township 35 North, Range 5 East, in the City of Nappanee, Indiana, more particularly described as follows; Beginning at an iron stake on the South line of Market Street (the South line of said street being parallel with and 41.25 feet South of the North line of said quarter section) at the intersection of the South line of said Street with the East line of the alley on the East side of BEST and EARLY'S ADDITION to said city; thence south eighty-nine (89) degrees forty-five (45) minutes East along the South line of said Market Street, four hundred and seventy-six hundredths (400.76) feet to an iron stake on the West line of a twelve (12) foot alley on the west side of I.R. GOOD'S FIRST ADDITION to said city; thence due South along the West line of said alley, six hundred ninety-five and thirty-five hundredths (695,35) feet to the North line of the right-of-way of the Baltimore and Ohio Railroad; thence North eighty-four (84) degrees six (6) minutes west along the North line of said railroad right-of-way, four hundred forty-eight and thirty-three hundredths (448.33) feet to an iron stake; thence North zero (0) degrees forty-eight (48) minutes East, parallel with and two hundred fifty- two (252) feet west of the east line of the west half (1/2) of said quarter (1\4) section, one hundred sixty-nine and eighty-seven hundredth (169.87) feet to the Southerly line of Lot Number four-hundred twenty-four (424) in BEST and EARLY'S ADDITION to said city; thence South eighty-nine (89) degrees thirty-one (31) minutes East along the Southerly line of said lot five and forty-one hundredths (5.41) feet to the Southeasterly comer of said lot; thence North zero (0) degrees twenty-seven (27) minutes East along the easterly line of said Lot Number four-hundred twenty- four (424) and the Northerly extension thereof, one hundred ninety-eight (198) feet to the Northerly line of Lincoln Street; thence South eighty-nine (89) degree thirty-one (31) minutes East along the Easterly extension of the northerly line of said street, thirty-three and ninety-three hundredths (33.93) feet to a cut on the concrete on-the Easterly line of an alley on the East side of said BEST and EARLY'S ADDITION; thence north zero (0) degrees twenty-three (23) minutes East along the East line of said alley, two hundred eighty-three and forty-seven hundredths (283.47) feet to the place of beginning. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the Office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
