NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing Tuesday, June 9, 2009 at 6:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this Hearing is to hear a variance request, #03-09-BZA, filed by owner Randy Yoder 27453 CR 150 Nappanee, IN 46550. The request is for a variance from the Nappanee Unified Zoning and Subdivision Control Ordinance to allow the continued use of an existing sign post that has a set back of 7 feet from the right-of-way. The Unified Zoning and Subdivision Control Ordinance requires a 10-foot set back. The property is located at 1850 E. Market St. Nappanee, IN LEGAL DESCRIPTION OF THE PROPERTY: A part of the Northwest Quarter of section 32, Township 35 North, Range 5 East, Union Township, Elkhart County, Indiana, being more particularly described as follows: Commencing at the Southwest comer of the Northwest Quarter of said Section 32; thence on an assumed bearing of due East along the South line of said Northwest Quarter, a distance of 442.50 feet and the beginning of this description; thence continuing on a bearing of due East along said South line a distance of 130.00 feet; thence North 0 degrees 15 minutes 40 seconds East parallel with the West line of said Northwest Quarter, a distance of 150.00 feet; thence on a bearing of due West parallel with the South line of said Northwest Quarter a distance of 130.00 feet; thence South 0 degrees 15 minutes 40 seconds West parallel with the West line of said Northwest Quarter, a distance of 150.00 feet to the point of beginning of this description. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
