NOTICE OF PUBLIC HEARING NAPPANEE BOARD OF ZONING APPEALS The City of Nappanee Board of Zoning Appeals will hold a Public Hearing, Tuesday, March 9, 2010 at 6:00 pm in the Council Chambers of the City Municipal Building, 300 West Lincoln Street, Nappanee, Indiana. The purpose of this Hearing is to hear variance request #01-10-BZA, filed by Christopher G. Walter, 699 Forest Court, Nappanee, Indiana 46550. The request is for a variance from the required 50-foot front yard set back on a primary arterial and a 30-foot set back on a local street in a B-2 General Business district. This variance will allow the construction of a 1600 square foot office with an attached 900 square foot garage that will have a 10 foot 6 inch front yard set back on Market street and a front yard set back of 8 feet 10 inches on Terrace Drive. The subject property is located at 1051 E. Market Street, Nappanee, IN 46550. LEGAL DESCRIPTION OF THE PROPERTY: A part of the northwest quarter of the southwest quarter of section 31, township 35 north, range 5 east, more particularly described as follows: Beginning at the northwest corner of said above described quarter section and running thence east 30 rods 15 1/2 feet for a starting point; thence south 11 rods 8 1/4 feet; thence east 49 feet; thence north 11 rods 8 1/4 feet; thence west 49 feet to the place of beginning, being situate within the corporate limits of the Town of Nappanee, Indiana. A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered. All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing may be continued from time to time as may be found necessary.
