Milford Studying Annexation Request

MILFORD - A proposal for the voluntary annexation of property topped the Milford Town Council meeting Monday.

A parcel of 32 acres on Old 15, owned by LMA-HUF Development LLC, Goshen, is located between the Lippert facility and the Royal Crown property. The parcel in question is currently zoned I-2 for industrial use.

"Basically, what we're asking for, is annexation," said Fred Ramser, chief operating officer of LMA Development. "This is a voluntary annexation, and we don't look at this as having any impact on the neighbors. The sole purpose of this ... is that because of the census in 2010, there is a freeze next year on any annexation.

"We're requesting to get this into Milford in the likelihood that this can be developed as industrial property. We want to be proactive if we get someone who is interested in coming in, if we can get utilities to it. As I understand it, you can't get utilities to the property if it's not annexed."

To begin the annexation process, the town must publish a notice of petition for annexation 20 days before a public hearing. The hearing will be Sept. 8.

During that meeting, a physical plan for the property will be presented. All affected landowners in the district will be notified regarding this plan. In this case, there is only one land owner who could be potentially affected.

The actual ordinance approving annexation could be passed in October. Since it's a voluntary annexation, 60 days are allowed for any objections. The process could be completed by Dec. 31.

"Once the ordinance is approved, you need to create an advisory board," said town attorney Jay Rigdon. "This board determines how the monies that are taxed on this parcel, and that are segregated from your general fund for three years ... how those are spent to make sure that services are provided in this area."

A motion was made and approved to conduct a hearing to review the physical plan for the voluntary annexation of the parcel of ground owned by LMA Development. That review will be Sept. 8 during the regular council meeting.

The council approved an abatement extension for Royal Outdoor Products, formally known as Royal Crown, Ltd. This is the second year the business has sought and been granted the extension.

The council approved an ordinance regulating the use of off-road vehicles in the town. Snowmobiles and golf carts are allowed within town limits, but under the ordinance, ATVs and UTVs are not.

There will be a preconstruction meeting regarding the Catherine Street project Aug. 21 at 10 a.m. at the town hall. This is open to the public. The contractor, NiBlock Excavating, Bristol, has 50 days to complete work. Sidewalks are almost completed, and water services under the street will be completed soon.

In other business:

n Acting Town Marshal Rich Miotto presented retired Marshal Dave Hobbs with an award from the town and the police department. The town is currently still in search for a full-time replacement for Hobbs.

n Fall cleanup is scheduled for the third and fourth weeks of September, on Thursday, Friday, and Saturday of each week.

n Milford Parks will be closed after Labor Day.

n The Milford Fire Department will hold its annual chicken barbecue the first weekend of October.
