Lead Paint Law Summary Available

A comprehensive study for determining lead-based paint laws in Indiana is now available for citizens to view.

Pam Kennedy, executive director of Housing Opportunities of Warsaw, presented the study titled "Lead Based Paint, The Law In Indiana: Improving Kid's Environment, Inc. Rights and Responsibilities of Tenant and Landlords."

Those who attended Wednesday's meeting included Kennedy, Laura Cooper of Housing Opportunities and Kathy Stanley, school nurse for Warsaw Schools.

The study was prepared by Janet McCabe, executive director of Improving Kids' Environment, Indianapolis.

Improving Kids' Environment is a non-profit advocacy coalition that facilitates improvements to children's health in identifying health environmental threats to children.

Founded in 1999, the organization focuses on lead poisoning prevention, environmental health threats to children and ensuring citizens have access to information about health threats.

According to the law, before a lease is signed, federal law requires landlords to disclose to prospective tenants any information they have about the presence of any known lead-based paint or lead-based paint hazards on the property.

Under Indiana's Landlord/Tenant Law, the landlord's basic obligations are to deliver rental premises in compliance with the rental agreement and in a safe, clean and habitable condition, comply with health and housing codes and make reasonable efforts to keep common areas in a clean and proper condition.

Kennedy also distributed a disclosure of information sheet on lead-based paint or lead-based paint hazards landlords are required to distribute to residents who seek to rent properties built before 1978.

The disclosure says housing built before 1978 may contain lead-based paint, and before renting pre-1978 housing lessors must disclose the presence of known lead-based paint or lead-based paint hazards in the dwelling. Lessees also must receive a federally approved pamphlet on lead poisoning prevention.

Kennedy also gave an update on reported lead cases in Kosciusko during the meeting.

Kennedy said there were three lead cases in Kosciusko County reported last month.

Kennedy said last month was Lead Task Force month and Ginger McKee, from the Women Infants and Children program, displayed lead paint hazard information at the WIC office.

Task force members are Missy Crawford-Smith, Ginger McKee, Laura Cooper, Pam Kennedy and Bob Hallmen.

The Lead Task Force will meet again Dec. 6 at 11 a.m. at the Kosciusko Community Foundation Building. [[In-content Ad]]
