Jury Trial Postponed for Syracuse Man Charged with Burglary, Battery

A Syracuse man arrested on a felony burglary and felony battery charge appeared in court Tuesday for a jury trial, though the state moved to continue that jury trial until March 4, 5 and 6, 2014.
Brandon Woody, 21, Syracuse, was charged with the felonies after Syracuse Police officers arrested him following an April 2013 incident. According to a probable casue affidavit filed in the Kosciusko County Prosecutor’s Office, officers responded to a report of burglary April 14 and found the victim in his backyard screaming with a swollen face and blood coming from his face, head and shoulder.
The victim told officers that two subjects had kicked in his door and that one of them had a gun. One subject struck him on the head with the handgun and proceeded to kick him while he was on the ground.
According to the report, the subject screamed “Where is she at?” and the victim thought they were referring to his wife, who he then told to run and hide. The victim’s wife ran and hid in the bathtub until police arrived.
The victim’s neighbor contacted police and told them he heard people running across his back deck yelling, and that he went downstairs inside a closed porch and found a pair of blue jeans and a black sweatshirt and did not know who they belonged to so he gave the clothing to police.
The following day, the neighbor advised police he had received a phone call from Woody who said he wanted his clothing back that he had left at the neighbor’s residence. The neighbor advised he had given the clothing to police and Woody reportedly became angry. A more extensive search yielded more clothing, a knife, a black BB gun and Woody’s identification card.
Woody was arrested following the incident.
Though his trial was continued until March, the state filed a charge of probation violation and Woody, who was previously released from prison one year ago on probation, was booked into the Kosciusko County Jail and has not bonded out as of today.
The jury trial is now scheduled for 9 a.m. March 4, 5 and 6, 2014, in Superior I Court in front of Judge Duane G. Huffer.[[In-content Ad]]
