Judge Mulls Fisher's Bond

Whether Jason Fisher will remain in jail or be released on bond was taken under advisement Friday and will be decided as soon as possible.
Kosciusko Circuit Court Judge Rex Reed said he wants to review the cases cited by Kosciusko County Prosecutor Charles Waggoner and court-appointed defense attorney, Michael Miner, in support ot their arguments.
Miner said bond should be set in the burglary and theft charges against Fisher, 23, of Millersburg. Those charges stem from a December 2000 theft of more than $100,000 worth of vehicles from Rice Ford in Warsaw. Three other men already have been sentenced for their role in the burglary.
Fisher also is being held on a charge of murder in the Jan. 15, 2001, shooting death of Kathy Vroman, 48, of Milford.
Fisher did not appear in court for the hearing.
Miner said a portion of the Criminal Rule 4 ruling that guarantees the right to a speedy trial allows for a defendant's release from custody on his own recognizance if he has been in custody for six months without trial and there are no delays attributed to the defense. Reed also wants to review the case file as to the time issue.
Although in another case Reed previously ruled that release of a defendant pursuant to C.R. 4 on a murder charge was unconstitutional, he said he wants to review the information presented to him Friday before he makes a decision.
Reed said he intends to set a "fairly low bond" of $5,000 to $10,000 on the burglary and theft charges. Fisher currently is being held without bond on the murder charge and bond was never set in the other charges, which were added in a December amendment to the case.
Waggoner said he is concerned that Fisher will be released prior to a scheduled Jan. 29 deposition and fail to appear for the interview.
Fisher, who has been jailed since last January, recently accused his father of committing Vroman's murder. Subsequently, Ralph Freddrick "Fred" Fisher, 47, of Goshen, was charged and arrested for that offense. The elder Fisher, too, is being held in the Kosciusko County Jail without bond.
Waggoner has made no comment as to how the filing of charges against Fred Fisher will affect the case against Jason Fisher. [[In-content Ad]]
