Hearing Officer Continues Unsafe Properties Discussion

Hearing Officer Lawrence Clifford Monday continued discussion on two Warsaw properties that have been deemed unsafe by the city.

The properties are at 614 E. Center St. and 415 N. Cook St.

The properties were previously discussed during a hearing in December.[[In-content Ad]]Michael Kelly lives at 614 E. Center St. During the December hearing he was ordered to finish siding his home.

Kelly Monday said he has purchased additional siding and will finish siding once the weather warms up.

The original notice of order requiring correction was sent to Kelly July 17.

Clifford said Kelly has until June 15 when the next hearing will be to side the home. Clifford said if by the June hearing the siding is not completed, a $1,000 civil penalty will be imposed.

Clifford said if Kelly confirms with the city that the siding has been completed, he will not be required to attend the June hearing.

The other property Clifford reviewed Monday is a vacant property at 415 N. Cook St.

The home was previously occupied by Jeanine Kinsey, who now lives at 3419 E. Pleasant Grove Drive.

Clifford ordered during the December hearing that a shed on the property be secured.

Building Commissioner Todd Slabaugh Monday said the shed is currently not secured.

Kinsey did not attend Monday's hearing. Clifford said he found a willful failure by Kinsey to not comply with the order to have the shed secured and then demolished. He imposed a $1,000 civil penalty on Kinsey.

A hearing will be June 15 to continue discussion on the property.
