Erosion Ordinance Passed

With a couple of changes, as suggested by Brad Jackson, a stricter erosion control ordinance was approved by county commissioners Tuesday.

The ordinance defines how violations should be handled, enforced and resolved.

"We feel it is a strong document and really needed," said Matt Sandy, Kosciusko County Area Plan Commission assistant planner.

For several months, a committee of lake-area residents, members of the Area Plan Commission and interested citizens crafted the ordinance and two others for the commissioners to review.

Regarding the erosion control ordinance, Jackson scaled back fines to $20-$150 per day with a cap of $1,000. As originally presented, the ordinance called for a $50-per-day fine with no maximum amount. The fines would have to be established by court order.

"The biggest enforcement tool will be revocation of building permits until the controls are in place," Jackson said.

The ordinance places the burden of erosion control equally upon the property developer, property owner and building contractor.

Jeff Noffsinger, Syracuse town manager, presented an ordinance regarding "shared use paths and shared roadways." This code paves the way toward construction of bike and pedestrian pathways along county roads.

The approved ordinance outlines the responsibilities and duties of a greenway applicant or developer as well as path specifications.

The board also:

• Appointed Wes Stouder to the Kosciusko County Economic Development Commission.

Warsaw Mayor Ernie Wiggins appeared at the meeting to appoint Michelle Boxell to the commission.

The commission will issue economic development bonds to and collect bond payments from the Louis Dreyfus Corp. The company plans to construct a biodiesel processing plant south of Claypool.

• Approved a rezoning of 20 acres, as requested by Jody Perdomo, from environmental to agricultural. The property is north of CR 200N, east of Ind. 13.

Dan Richard, plan commission director, said the plan commission gave the request a favorable recommendation. When the county established zoning areas in the early 1970s, the property was a classified forest. That classification was dropped in the mid-1970s and there was not reason to retain the environmental zone.

• Approved reclassification of Wooster Road in Winona Lake as a minor collector from CR 250E to King's Highway.

Commissioners are Jackson, Avis Gunter and Ron Truex. Truex was absent. [[In-content Ad]]
