ELKHART COUNTY - PROPOSED REPLACEMENT ZONING ORDINANCE

PROPOSED REPLACEMENT ZONING ORDINANCE
INCLUDING ZONING MAPS
    Notice is hereby given that the Plan Commission of Elkhart County, Indiana on the 2nd day of December, 2014 at 6:00 PM local time, will hold a public hearing for a proposed replacement Zoning Ordinance, including zoning maps, for Elkhart County, which replacement Ordinance will repeal the existing Zoning Ordinance it its entirety.  The applicant/petitioner is the Elkhart County Plan Commission. This public hearing will be held at the Elkhart County Department of Public Services Building, Public Meeting Rooms A & B, 4230 Elkhart Road, Goshen, IN 46526.
    The geographic area to which the proposed replacement Zoning Ordinance, including zoning maps, applies is all lands within Elkhart County, including all the Townships: Cleveland, Osolo, Washington, York, Baugo, Concord, Jefferson, Middlebury,  Olive, Harrison, Elkhart, Clinton, Locke, Union, Jackson and Benton, but excluding the jurisdictions of the City of Goshen, the City of Elkhart, and the Town of Nappanee.
    The following is a summary of the subject matter contained in the proposed replacement ordinance, including zoning maps:
    Article One – General Provisions:  This article contains basic provisions for the Ordinance such as purpose, jurisdiction, effective date, and repealing the existing Zoning Ordinance in its entirety.
    Article Two - Development Review Bodies:  This article sets forth the development review, recommendation and final decision roles of various Commissions, Boards, Committees, and Staff members.
    Article Three – Development Review Procedures:  This article shows the steps required to receive a final decision on various development review procedures such as Rezonings, Special Use Permits, and Building Permits.
    Article Four - District Developmental Standards:  This article contains the purpose statements for each zoning district and establishes regulations that include, but are not limited to, building setbacks, heights, and building coverage.
    Article Five - Use Standards:  This article contains a use table which sets forth what uses are allowed by right, allowed subject to limitations, allowed by Special Use Permit, or prohibited in each zoning district.  It also contains specific use standards that apply to certain uses in certain zoning districts as well as standards for wireless communication facilities and accessory uses and structures.
    Article Six - Special Purpose and Overlay Zoning Districts:  This article contains the standards and procedures for special purpose and overlay zoning districts.  
    Article Seven – General Development Standards: This article contains standards for multiple-family and nonresidential development related to off-street parking, loading and stacking; buffering and screening; signs; and flood hazard control.
    Article Eight - Nonconformities: This article establishes provisions for nonconforming uses, nonconforming structures (including signs), and nonconforming parcels or lots of record.
    Article Nine – Enforcement, Violations and Penalties: This article establishes who enforces the Zoning Ordinance, describes what constitutes a violation and sets forth penalties for violations.
    Article Ten – Definitions: This article includes definitions for terms, abbreviations, and acronyms used in the Ordinance.
    Zoning Maps – A total of 15 zoning districts are included in the proposed replacement ordinance.  The W-, Wellhead Overlay, zoning district is not reflected or used on the proposed replacement maps. The proposed maps mirror the existing zoning maps.  
    The following is Section 9.3, Penalties, of the proposed Zoning Ordinance:
    Sec. 9.3. Penalties
    9.3.1    Upon conviction, any person found in violation of this Ordinance will be fined no more than $2,500.00 for the first violation and not more than $7,500.00 for second or subsequent violations.  
9.3.2    Each day during which a violation occurs or continues shall constitute a separate or subsequent violation.
    Oral comments concerning the proposed replacement Zoning Ordinance, including zoning maps, will be heard and considered at the public hearing.  Written comments concerning the replacement Zoning Ordinance, including zoning maps, can be filed with the Department of Planning and Development at the address listed below on or before December 2, 2014 by the end of office hours in order to be considered by the Plan Commission.  Written comments will be distributed and presented to the Plan Commission for consideration at the public hearing.  The public hearing may be continued by the Plan Commission to future meetings as may be found necessary by the Plan Commission and as announced at the public hearing.
    A copy of the proposed replacement Zoning Ordinance, including zoning maps, is on file and is available for public inspection at the following location:
