County Planners Tentatively OK Lot Division

Kenneth and Vera Mullet recently bought the lot on the south side of CR 1350N, east of CR 750W, with the intention of splitting it in half. Kenneth Mullet is requesting permission to replat the lot into a 7.1 acre tract and a 10.9 acre tract.
He told APC members Wednesday he would like to convert existing buildings on the property into farm uses such as horse and buggy storage.
Members unanimously gave preliminary approval, but noted that county commissioners only approved rezoning the land from agricultural to agriculture II in 1995 after receiving assurance from then-landowner Shirley Cunningham that it would not be subdivided. The fear, Area Plan Director Dan Richard noted, was that a 20 acre tract of agricultural land might be cut into 20 1-acre residential lots.
“The original owners made the promise not to subdivide, and I’m not sure (county commissioners) would have rezoned without that assurance,” he remarked. “Making a motion to accept the plat is the same as rescinding the original agreement not to subdivide.”
APC member Chuck Haffner moved to give preliminary approval, noting that the neighborhood has changed since 1995 – some adjoining lots have been annexed by Nappanee, for instance. The commission will consider final approval during their meeting next month.
