County Approves Vacation Petition

The petitioner, Agnes Mary Brooks, asked the county to vacate the land. Commissioner Ron Truex said granting the vacation was the right thing for the county to do because the small strip of land no longer contains a county road. Sections of the old roadway have been vacated one by one in the past few years.[[In-content Ad]]Area Plan Director Dan Richard said two or three sections remain to be vacated. The commissioners asked the planning office to pursue vacating the remaining sections of the old road as soon as possible.
County attorney Mike Miner reported to the commissioners on a settlement agreement reached between the county and Midwest Tile.
Midwest Tile was involved in construction of the Kosciusko County Justice Building in 2002. After a discrepancy involving a staircase the company installed, Midwest Tile sued the general contractor of the project and the county. The settlement includes a $12,000 payment to Midwest Tile. Miner said the settlement costs the county less than it would cost to try the case in court. The commissioners approved the settlement.
Miner also reported that the county has yet to receive $20,000 from Motorolla. The communications company agreed to refund the county $20,000 as part of a settlement after work on a communications system at the Kosciusko Sheriff's Department did not satisfy the sheriff's department's requirements.
Miner told the commissioners Motorolla representatives have failed to return several of his phone calls about the issue.
"We've gotten lost in a big corporation," he said. "The guys who made the agreement got transferred."
Miner suggested the county file suit to claim the settlement money. The commissioners gave Miner the OK to file suit.
The commissioners also opened bids for highway department materials for 2008. The bids are open-ended, setting prices the county will have to pay for gravel, metal and other materials the highway department uses.
