Commissioners Ask Planners To Look At Vacation Request

Even though the Kosciusko County Commissioners denied a vacation request by 13 South Storage Condominiums Inc. and Deborah K. Thompson, the petitioners ultimately still will get what they wanted.

The vacation was for a 261-foot cul de sac-platted right of way south of CR 500N on the east side of Ind. 13.

Matt Sandy, Kosciusko County Area Plan Commission assistant planner, said the plan commission staff believes it would be more appropriate for the plan commission to look at the request as the right of way is part of a plat the plan commission approved. No negative responses were received from emergency services regarding the vacation, but Kosciusko County Highway Superintendent and Engineer Rob Ladson did provide a letter stating that the plan commission should review the matter.

"At the minimum," Sandy said, "the plan commission needs to look at it because of a change in the plat." He said the plan commission highly recommended that the vacation be denied.

Attorney Steve Snyder, representing the petitioners, said his clients are not changing the plat, they are just eliminating the public's right to it by vacating the access. If it's vacated, and there are no curbs and gutters, then the county doesn't have to take the right of way into the county system and that is fine with his clients and with Ladson, Snyder said.

"It affects two people," he said. "Those people are the petitioners."

There were no remonstrators to the petition.

The commissioners voted to deny the vacation and send it back to the plan commission. Commissioner Brad Jackson said the plan commission should be informed that they can release the subdivision's bond and the right of way won't be a part of the county maintenance system.

In other business, the county commissioners:

• Approved Tom Brovont's request to rezone 15.5 acres from an agricultural to residential district. The property is on the west side of Ferguson Road, south of Rozella, in Wayne Township.

• Denied Open Bible Baptist Church's request to rezone property from agricultural to residential. The property is in Plain Township, on Chapman Lake Drive.

• Denied Donald Longacre's petition to rezone approximately seven acres from agricultural to agricultural 2, but approved it to be rezoned residential. The property is on CR 900N, east of Quaker Haven Estates near Dewart Lake.

• Approved Ladson's recommendation for the purchase of two 2004 tandem axle cab and chassis trucks with bed, hydraulics, sander and underbody from Hill Truck Sales for $240,628. It was the lowest of three bids the county received.

• Heard from Sheriff Aaron Rovenstine that his department is working on their Web site, posting information on the sheriff sales online. He said it would be nice if people would look up the sales information there to save the department some time. The Web site is at www.kcgov.com Under "county offices," under "sheriff," look under "events" for the information.

• Approved the Warsaw Community Development Corp.'s request to use the county courthouse lawn June 25-26 for the sesquicentennial festival.

• Approved the town of Silver Lake to use county roads as detours while Ind. 14 is closed for Silver Lake Days June 19 from 9:30 a.m. to 12:30 p.m.
