ORDINANCE NUMBER 2012-06-02
AN ORDINANCE ANNEXING CERTAIN TERRITORY
TO THE CITY OF WARSAW, INDIANA
    WHEREAS, Board of Aviation Commissioners City of Warsaw ("Owner(s)"), have petitioned the Common Council of the City of Warsaw, Indiana ("Common Council") to annex certain real estate into the municipal territory of the City of Warsaw, Indiana pursuant to Indiana Code 36-4-3-5.1; and
    WHEREAS, Owners are the owners of 100% of the land in the territory sought to be annexed and 100% of the total assessed value of the land for property tax purposes; and
    WHEREAS, a Petition for Voluntary Annexation was introduced to the Common Council of the City of Warsaw on April 16th, 2012, and a public hearing was scheduled for the annexation on May 21, 2012; Publication of Public Hearing Notice appeared in the Warsaw Times-Union on April 26, 2012 for the annexation. The public hearing on the annexation was held at a regular meeting of the Common Council on May 21, 2012. The fiscal plan was presented and approved by the Common Council of the City of Warsaw, Indiana, concurrent with the adoption of the Ordinance on May 21, 2012; and
    WHEREAS, the Common Council of the City of Warsaw, Indiana has determined that the areas should be annexed in to the City of Warsaw, Indiana.
    NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF WARSAW, INDIANA:
    1. That the following described real estate be, and it hereby is, annexed into the municipal territory of the City of Warsaw, Indiana, in accordance with Indiana Code 36-4-3-1, et seq., effective July 4, 2012.
    The following described REAL ESTATE in Kosciusko County, in the State of Indiana, to-wit:
        A tract of land in the northeast quarter of section 33, township 33 north, range 6 east, Plain Township, Kosciusko County, Indiana, more particularly described as follows:
    Beginning at the northwest corner of Government Lot Number One (1) and Government Lot Number One (also the Monoquet Reserve Line) for 1115.20 feet;
    Thence north 89 degrees 1 minute 32 seconds east parallel to the north line of said quarter section for 2909.78 feet to a point on the east section line of said section;
    Thence north 00 degrees 56 minutes west along the east section line of said section, for 1110.390 feet to a mag nail located at the northeast corner of said fractional quarter;
    Thence south 88 degrees 55 minutes 19 seconds west along north section line of said fractional quarter and within the right of way of County Road 300 North, 1049.71 feet to a mag nail;
    Thence south 00 degrees 57 minutes 47 seconds east, parallel with the east line of said northeast quarter, 753.00 feet to a Kimpel Capped 5/8" pin;
    Thence south 88 degrees 11 minutes 52 seconds west, 749.19 feet to a Kimpel Capped 5/8" pin;
    Thence north 00 degrees 57 minutes 47 seconds west, parallel with said east line, 762.16 feet to a mag nail on the north line of said Government Lot One (1);
    Thence south 88 degrees 55 minutes 19 seconds west along north section line of said fractional quarter and within the right of way of County Road 300 North, 1134.05 feet to the northwest corner of Government Lot One (1) also the point of beginning.
    2. The area shall be zoned I-2/Industrial District
    3. The area shall be located in the Council District 5.
    4. This ordinance shall take effect July 4, 2012, following its publication in the Warsaw Times-Union, in the absence of remonstrance and appeal under Indiana Code 36-4-3-5.1 or Indiana Code 36-4-3-15.5, and upon the filing of a certified copy of the ordinance with the Kosciusko County Auditor, the Kosciusko County Circuit Court Clerk, Board of Registration, and the Office of Secretary of State, all pursuant to Indiana Code 36-4-3-22.
    ADOPTED this 4th day of June, 2012.
