A Pierceton man involved in a wreck Monday that left him in serious condition in a Fort Wayne hospital is looking at a potential felony charge.
According to a report from the Kosciusko County Sheriff’s Department, charges of driving while intoxicated causing serious bodily injury against Andrew G. Peters, 28, of 6075 E. CR 150N, Pierceton, were forwarded to the prosecutor’s office this week.
Around 1:30 p.m. Monday, Peters was eastbound on CR 100N when he allegedly crossed the center line and his 1990 Mazda struck a Jeep driven by Melissa S. Fitzsimmons, 30, of 6287 E. CR 100N, Pierceton.
According to the KCSD report, a blood sample from Peters came back and showed he had a blood alcohol content of .155, nearly two times the legal limit.
During an investigation, it also was discovered Peters had a suspended license from a prior conviction of driving while intoxicated.
That charge came within the last five years.
Peters was airlifted from the accident and taken to Parkview Hospital in Fort Wayne.
He suffered broken ribs and a severe injury to one of his legs.[[In-content Ad]]He was listed in serious but stable condition earlier this week.
Fitzsimmons was treated and released from Kosciusko Community Hospital with an ankle injury.
An infant in the back seat of Fitzsimmons’ vehicle was uninjured.
Since Peters had a DWI conviction within five years of this incident, it raises the charge from a Class D to Class C felony.
