4-Year Sentence Meted In Zale Drugs Break-In

One of the men responsible for breaking into Zale Drugs, 1775 E. Center St., Warsaw, in March 2010 was sentenced Thursday morning.

Zachary Adams, 27, South Bend, was sentenced to four years in the Indiana Department of Corrections for attempted burglary, a Class C felony.

Adams was credited for 672 days in jail and with good time he was credited with 1344 days. With good time Adams will spend 56 days in prison.  

Adam’s Sentence will be served concurrently with any federal district court of Northern Indiana sentencing.

As per Adam’s plea deal signed on Aug. 30, in exchange for his guilty plea on the Class C felony the state of Indiana would dismiss counts two through nine: attempted theft, a class D felony; attempted possession of a controlled substance within 1000 feet of a school, a Class C felony; burglary, a Class C felony; theft, a Class D felony; possession of a controlled substance within 1,000 feet of a school, a Class C felony; burglary, a Class C felony; theft, a Class D felony; possession of a controlled substance within 1,000 feet of a school, a class D felony, and the habitual offender enhancement.

Kosciusko County Circuit Court Judge Rex Reed ordered Adams to pay a $1 fine and court costs. Additionally Reed ordered Adams to pay $1,775.91 in restitution.

According to the probable cause affidavit, on March 15, 2010,  Adams, Michael Cavinder and another unknown male broke into Zale Drugs and stole 300 Vicodin tablets, 7,430 tablets of several different types of Hydrocodone, 352 Percocet tablets, and 1,000 tablets of Oxycodone.  

The three men wore dust masks, black cotton gloves, and carried trash bags. According to the probable affidavit the dust masks, gloves and a black knit hat where found near The Pit Stop.  

The hat and dust masks were sent to the Indiana State Police Crime lab for DNA testing. When the test results came back both Adams’s and Cavinder’s DNA were found and a third unknown subject’s DNA was found.
