2 Plead In Separate Jury Trials

Kosciusko County Prosecuting Attorney Daniel H. Hampton scheduled two jury trials for today, but neither panned out.
Both defendants pleaded guilty prior to starting their jury trials.
Sean Jayne, 23, of 309 E. Main St., Silver Lake, was scheduled to start jury selection and trial at 9 a.m., but he was not available and Hampton called in the second defendant, Wesley Kern, 26, of 4057 N. Sullivan Road, Leesburg.
Slightly before 9 a.m., after attorney Scott J. Lennox spoke with his client, Kern, Lennox presented Kosciusko County Superior Court I Judge Duane Huffer with a plea deal.
Kern pleaded guilty to criminal recklessness, a Class D felony, and carrying a handgun without a permit, a Class A misdemeanor. As per the plea, the sentences for each count will run concurrently and there is a limitation of a one-year sentence on both.
Huffer accepted the plea deal, but ordered a presentence investigation report to be filed with the court and ordered Kern to be back in court for sentencing Sept. 26 at 8:30 a.m.
On Jan. 26 at approximately 3 p.m., Kern rode with Ray Skelton and Cilfford Carden to the Jot Em Down Store on North Barbee, Warsaw. At some time while Skelton, Carden and Kern were at the Jot Em Down Store, Kern allegedly pulled a gun out and shot at Carden from the vehicle. Then Kern got out of the vehicle and allegedly chased Carden while shooting at him.
Sheriff’s deputies found a .22 caliber spent round inside Skelton’s vehicle.[[In-content Ad]]After Kern pleaded guilty, Jayne arrived at the Justice building in time for his jury trial. Prior to starting the trial, Lennox spoke with Jayne for a few minutes and then Jayne entered the court to plead guilty.
Jayne pleaded guilty to theft, a Class D felony, and carrying a handgun without a license by a felon, a Class C felony. As per the plea deal, Jayne pleaded guilty to counts one and two, and count three, a habitual violator enhancement, would be dismissed.
Jayne was previously convicted of theft three times: twice in 2007 and once in 2009.
Huffer accepted the plea deal, but ordered Jayne to be back in court Sept. 26, at 8:30 a.m. for sentencing.
On Feb. 20, Jayne drove with Burley Adams to Lowe’s to get some building supplies. During the ride to Lowes, Adams’ .38 caliber Savage handgun slid out from underneath the seat of the vehicle.
After Adams and Jayne retrieved the supplies, he dropped Jayne off at his home.
On Feb. 21, Adams went out to his vehicle and found that his handgun had been stolen and he confronted Jayne. Jayne denied stealing his handgun, but a family member allegedly informed Adams that Jayne had previously stolen one of his father’s and sold it to Edward Franklin.
Adams went to Franklin and found the gun that Jayne allegedly sold for $110.
