NOTICE TO BIDDERS-CITY OF WARSAW-EAST MAIN STREET

Notice is hereby given that the Board of Public Works and Safety for the City of Warsaw, Kosciusko County, Indiana will receive sealed bids for EAST MAIN STREET PROJECT at the office of the City Clerk-Treasurer located at 102 South Buffalo Street, Warsaw, Indiana (City Hall) until Monday September 12, 2016 at 10:30 a.m. (local time). Any Bids received after this time will be returned unopened. All Bids received by the stated deadline will be publicly opened and read aloud immediately following the submittal deadline in the Council Chambers at the same address.
The work shall include, but is not necessarily limited to: 3” milling of approximately 9700 square yards of East Main Street; installation of approximately 9700 square yards of geotextile fabric; installing approximately 1,350 tons of HMA Surface and 1,100 tons of HMA intermediate; installation of various pavement traffic markings; and, other incidental work items.
All bids shall be properly and completely executed on the proposal forms provided with the plans and specifications including the non-collusion affidavit and Form 96 – Contractor’ s Bid for Public Works, as required by the State Board of Accounts. Form 96 is available on the State of Indiana Government website at www.in.gov, and entering “Form 96” in the search engine.
A bid bond or certified check in an amount of ten percent (10%) of the amount bid, and made payable to the City of Warsaw, Indiana, must be submitted with each bid as guaranty that the terms of the bid will be carried out. All bonds must be secured from a bonding company as listed in the current edition of the U.S. Treasury Department, Circular #570, and authorized to transact business in the State of Indiana. The Board of Public Works and Safety reserves the right to reject any and all bids.
Contract Documents for the Project prepared by the City of Warsaw, setting forth in detail the plans and specifications for said work, are available at the Public Works Department located at 794 West Center Street, Warsaw, Indiana or by calling the Public Works Department at (574-372-9561).
In accordance with IC 22-5-1.7-11.1, Contractors entering into a contract with the Owner, and contractors of any tier as defined in IC 5-16-13-4, will be required to enroll in and verify the work eligibility status of all newly hired employees through the E-Verify program (effective July 1, 2011), and comply with the reporting requirements of IC 5-16-13-11.
In accordance with IC 5-22-16.5, Contractors entering into a contract with the Owner will be required to provide an Indiana Iran Investment Certification.
In accordance with IC 5-16-13-11, Contractor shall submit an Employee Drug Testing Plan with their Bid and contractors of any tier as defined in IC 5-16-13-4 must comply with the drug testing requirements set forth in IC 4-13-18. Contractor shall complete a Drug Testing Plan Certification to be submitted with their Bid.
Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of City of Warsaw, should contact the office of Jeremy Skinner, 102 S. Buffalo St., Warsaw, IN 46580, phone (574) 372-9550, as soon as possible but no later than 48 hours before the scheduled event.
The City of Warsaw in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office the Secretary, Part 21, Nondiscrimination in Federally assisted programs of the Department of Transportation and Title 23 Code of Federal Regulations, Part 200, Title VI Program and Related Statutes, issued pursuant to such Acts, hereby notifies all bidders that it will affirmatively insure that in any contact entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of religion, race, color, national origin, sex, sexual orientation, gender identity, age, disability/handicap and low income in consideration for an award.
No bidder may withdraw any bid or proposal within a period of thirty (30) days following the date set for receiving bids or proposals. The Board of Public Works and Safety reserves the right to waive informalities and reserves the right to reject and/or cancel any and all bids, solicitations and/or offers as specified in the solicitations when it is not in the best interests of the governmental body as determined by the purchasing agency in accordance with I.C. 36-1-12.
A one hundred percent (100%) performance and payment bond will also be required of the successful bidder.
It is intended that actual construction of all work shall begin no sooner than September 15, 2016 and finish by October 31, 2016, and that each bidder shall be prepared to enter promptly into a construction contract, furnish required bonds, furnish a certificate of insurance, and begin work without delay.
