Warsaw Man Arrested After Officers Respond To Fatal Overdose

A Warsaw man was arrested for maintaining a common nuisance after a officers responded to a fatal overdose.
Bret Allen Bailey, 60, of 5755 S. East Channel Road, Warsaw, is charged with maintaining a common nuisance, a level 6 felony.
He was booked into the Kosciusko County Hail at 2:33 a.m. Jan. 12 on a $5,250 preliminary bond.
According to the probable cause affidavit, on Jan. 11 law enforcement responded to a drug overdose. Officers and medics arrived at the scene to find a man unresponsive, not breathing and without a pulse. Medics were unable to revive the man and he was pronounced dead.
A NET 43 officer spoke with Bailey. Bailey said he was at the residence when he heard the man yelling. Another man and Bailey went into the bedroom and found the man unresponsive. They carried the man into the kitchen were they gave him CPR and Narcan until medics arrived.
An officer talked to the responding officer who said, upon entering the residence, they saw in plain view a grey smoking device, which then disappeared.
The officer had prior knowledge NET 43 had received a tip of drug use at the residence. On April 11, 2022, officers had also responded to a drug overdose at the residence.
The officer requested to search the residence and Bailey refused the search. On Jan. 12, a search warrant for the residence was granted and served to Bailey.
Officers searched the residence and found a rifle, three foils with black residue, four yellow shotgun shells, 15 0.22 shells, two large scales, cell phones, tubes with white residue, weed cigarette, magnetic box, a black hide-a-book, 15 pieces of foil with burnt residue and a vape pen.
During the search of the bathroom, the countertop was damp along with plates of the scale that made it appear someone had attempted to clean up. An officer saw a dried white streak that field tested positive for methamphetamine.
