Notice Is Hereby Given, That The Kosciusko County Area Plan Commission Shall Hold A Public Hearing On A Petition Filed by BEN & DANELLE BARKEY Requesting An Amendment To the Kosciusko County Zoning Ordinance, To Reclassify From an Agricultural District to an R Residential District.

Part of the Northeast Quarter of Section 36, Township 32 North, Range 6 East, Kosciusko County, Indiana (This description prepared by Ryan D. Peppler, LS22300014, as part of original survey QG-140 "B" completed by J.K. Walker & Associates, P.C., dated January 30, 2025), being more particularly described as follows, to wit:
Commencing at a Mag nail found at the Northwest comer of said Northeast Quarter; thence S00°-00'-50"E (adjoiner's deed bearing and used as the basis of bearings for this description), on and along the West line of said Northeast Quarter, a distance of 927.00 feet to a Mag nail found at the Southwest comer of a certain 3.00 acre tract of land as recorded in Document Number 2024100502 in the records of Kosciusko County, Indiana, said Mag nail also being at the POINT OF BEGINNING; thence continuing S00°-00'-50"E, on and along said West line, being within the right-of-way of County Road 350E, a distance of 393.15 feet to a Mag nail found at the Southwest comer of the Northwest Quarter of the Northeast Quarter of said Section 36; thence S89°-19'-25"E, on and along the South line of the Northwest Quarter of the Northeast Quarter of said Section 36, a distance of 326.53 feet to the point of intersection with an open ditch, said point being situated S89°-19'-25"E, a distance of 21.7 feet from a 5/8-inch iron pin capped "Walker" found and being situated N89°-l9'-25"W, a distance of 22.0 feet from an iron pin found; thence continuing S89°-19'-25"E, on and along said South line, a distance of 996.29 feet to an iron pin found at the Southeast comer of the Northwest Quarter of the Northeast Quarter of said Section 36; thence N00°-02'-46"E, on and along the East line of the Northwest Quarter of the Northeast Quarter of said Section 36, a distance of 5.50 to a Mag nail at the point of intersection with the centerline of Wilcox Road; thence N89°-19'-25"W, on and along said centerline, a distance of 75.00 feet to a Mag nail; thence Northwesterly, on and along said centerline, being defined by a regular curve to the right, having a radius of 700.00 feet, an arc length of 160.35 feet (the chord of which bears N82°-45'-40"W for a distance of 160.00 feet) to a Mag nail; thence Northwesterly, on and along said centerline, being defined by a regular curve to the right, having a radius of 540.00 feet, an arc length of 150.49 feet (the chord of which bears N68°-12'-55"W for a distance of 150.00 feet) to a Mag nail; thence N60°-13'-54"W, on and along said centerline, a distance of 203.31 feet to a Mag nail; thence Northwesterly, on and along said centerline, being defined by a regular curve to the left, having a radius of 800.00 feet, an arc length of 217.84 feet (the chord of which bears N68°-01'-57"W for a distance of 217.17 feet) to a Mag nail; thence N75°-50'-00"W, on and along said centerline, a distance of 114.21 feet to a Mag nail found at the Southeast comer of said 3.00 acre tract of land; thence continuing N75°-50'-00"W, on and along said centerline, a distance of 475.66 feet to the point of beginning, containing 6.00 acres of land, more or less, subject to legal right-of-way for County Road 350E and Wilcox Road, subject to all legal drain easements and all other easements of record.
This Change Is Requested To Permit the Above Described Real Estate to Be Used For The Purpose of Residential Uses as defined in the Kosciusko County Zoning Ordinance.
This Hearing Will Be Held in the Commissioner's Meeting Room, County Court House 100 W Center St., Warsaw On 03/05/2025 At 1:00 P.M.
All interested persons are invited to attend and be heard. Written comments will be considered if they are received in the Office of the Kosciusko County Plan Commission, Court House, Warsaw, Indiana, no later then 72 hours before the meeting, (mailing address: 100 W Center St, Rm 303, Warsaw, IN 46580). Any digitally submitted comments or exhibits on devises, such as but not limited to, flash memory drives, thumb drives, or external drives must be submitted to the office 72 hours before the hearing any presented at the meeting will not be viewed in accordance with the Kosciusko County Cybersecurity directives.
