Abbott Authors Legislation To Protect Property Owners' Rights Against Unauthorized Occupants

STATEHOUSE – State Rep. David Abbott (R-Rome City) has authored legislation which aims to enhance protections for Hoosier property owners dealing with squatters on their property.
House Bill 1189 would establish new legal procedures for removing squatters and unauthorized individuals from residential properties, according to a news release.
"House Bill 1189 would streamline the process for Hoosiers to reclaim their property from those who are illegally occupying it while ensuring that law enforcement has clear authority to act swiftly," Abbott said. "This is a common-sense protection to ensure property owners' rights are upheld."
Abbott said this legislation introduces an affidavit process that would allow for property owners to request the immediate removal of squatters. It also imposes strict civil penalties if an individual knowingly makes a false statement regarding occupancy.
Under HB 1189, law enforcement agencies would be required to serve an immediate notice to vacate and restore property possession to the rightful owners. A person who enters a dwelling without the owner's permission and intentionally causes damages would also be committing a level 6 felony. According to Abbott, the legislation is not meant to be an alternative to existing legal procedures between landlords and tenants.
