NOTICE OF PUBLIC HEARING
Notice is hereby given to the citizens of the City of Nappanee, Elkhart and Kosciusko County, State of Indiana, that a public hearing will be conducted by the Common Council of the City of Nappanee on an Ordinance to continue an Economic Improvement District for the Nappanee Downtown Business Improvement District, Nappanee, Indiana.
The boundaries of the proposed Economic Improvement District are as follows:
Commencing at a point where the centerline of Main Street intersects the North right-of way line of the Chessie System Railroad right-of-way; thence West along the North right of-way line of the Chessie System Railroad right-of-way to the centerline of Locke Street; thence North on the centerline of Locke Street to the point where the centerline of the alley South of Lots 1, 2, 3, and 4 in Metzler’s First Addition intersects the centerline of Locke Street; thence West on the centerline of said alley to the centerline of Nappanee Street; thence North on the centerline of Nappanee Street to the centerline of Market Street (U.S. 6); thence East on the centerline of Market Street (U.S. 6) to the West line (if extended south to the centerline of Market Street) of Lot 34 in Fahlstrom’s Second Addition; thence North along the West line (if extended) and the West line of said Lot 34 to the centerline of the alley North of Lots 32, 33, and 34 in Fahlstrom’s Second Addition; thence East along the centerline of said alley to the centerline of Locke Street; thence North along the centerline of Locke Street to the centerline of Walnut Street; thence East along the centerline of Walnut Street to the centerline of Clark Street; thence North along the centerline of Clark Street to the centerline of the alley North of Lots 25, 26, and 27 in Fahlstrom’s First Addition; thence East along the centerline of said alley to the centerline of Main Street; thence South on the centerline of Main Street to the centerline of Walnut Street; thence East on the centerline of Walnut Street to the centerline of Elm Street; thence South on the centerline of Elm Street to the South right-of-way line of Lincoln Street; thence East approximately thirty-three feet (33’) to the Northwest corner of Lot 46 in the original Town (now City) plat of Nappanee; thence South approximately 89.44 feet to the South line of the original Town (now City) Plat of Nappanee; thence West along the South line of said Plat to the centerline of Main Street; thence South along the centerline of Main Street to the point of beginning.
ESS AND EXCEPTING: Lot 18, Lot 25, and the North sixty feet (60’) of Lot 27 in Fahlstrom’s First Addition to the City of Nappanee.
ALSO LESS AND EXCEPTING: The West sixty-nine feet (69’) of Lot 14 in the original Town (now City) Plat of Nappanee; the East sixty-six feet (66’) of Lot 10 in the original Town (now City) Plat of Nappanee; the West sixty-six feet (66’) of Lot 16 in the original Town (now City) Plat of Nappanee; and Lot 15 in the original Town (now City) Plat of Nappanee.
The District is proposed to be continued for the purpose of coordinating the efforts of the real estate owners within the District to provide capital improvements, maintenance projects, and business enhancing projects within the District specifically including:
(a) Planning or managing development or improvement activities;
(b) Designing, landscaping, beautifying, constructing, or maintaining public are as or public ways (including designing, constructing, or maintaining lighting for a public area or public way);
(c) Promoting commercial activity or public events;
(d) Supporting business recruitment and development;
(e) Providing security for public areas;
(f) Acquiring, constructing, or maintaining parking facilities; and
(g) Constructing, rehabilitating, or repairing residential property.
Each parcel of real estate within the proposed District would be annually assessed an amount based upon the current assessed valued or current assessed valuation, as defined by I.C. 6-1.1-1-3, for the non residential improvements on a parcel in accordance with the following schedule:
Assessed Value of Non-Residential Improvements Special Assessment Amount Less than $50,000.00 $100.00
$50,000.00 - $100,000.00 $200.00
Greater than $100,000.00 $300.00
Tax exempt parcels would not be subject to assessment.
The public hearing will be held on Monday, October 7, 2024 at 7:00 P.M. in the Council Chambers at the Nappanee Municipal Center, 300 West Lincoln Street, Nappanee, Indiana.
At the public hearing, the Common Council shall hear all owners of real property in the proposed District (who appear and request to be heard) upon the questions of:
1. The sufficiency of the notice;
2. Whether the proposed economic improvement projects are of public utility and benefit;
3. Whether the formula to be used for the special assessment of special benefits is appropriate; and
4. Whether the district contains all, or more or less than all, of the property specifically benefited by the proposed projects.
