ORDINANCE 2024-
WHEREAS, pursuant to the authority of the Town of Leesburg, Indiana (the "Town") to establish reasonable regulations for the health, safety, and welfare of the citizens of the Town; and
WHEREAS, the Town Council for the Town seeks to establish reasonable regulations for the operation of any parks owned by the Town; and
IT IS HEREBY ORDAINED by the Town Council of the Town of Leesburg, Indiana as follows:
SECTION 1: In addition to any penalty provide in this ordinance, any person or entity found to be in violation of any of the rules or regulations of this ordinance may be subject to suspension from any park or recreational grounds now owned by the Town of Leesburg or to be owned by the Town of Leesburg in the future.
SECTION 2: Any individual designated by a majority vote of the Town of Leesburg Town Council is hereby authorized to enforce the rules and regulations provided in this ordinance.
SECTION 3: Any person or entity on the premises of a town park who disregards the orders of a designee from the Town Council may be immediately evicted from the park.
SECTION 4: The Town Council may temporarily close or curtail activities upon any park owned by the Town when it has been deemed necessary to be in the best interest of public safety, conduct, health or order.
SECTION 5: The Town Hall, currently located at 100 E. Van Buren St., Leesburg, IN 46538, shall be open to the public, excluding holidays, Monday through Friday from 9:00 a.m. to 4:30 p.m. Additionally, the Town Hall shall be open to the public on the second Monday of each month from 6:15 p.m. to 7:45 p.m. Clover Park, along with any other park or recreation area that is owned by the Town or maintained by the Town shall be open for public use on a year-round basis from sunrise to sunset.
SECTION 6: It shall be unlawful for any person to be present in a town park from sunset to sunrise.
SECTION 7: The Town shall not be responsible for accidents involving property damage or personal injury resulting from activities in town parks over which the Town has no control.
SECTION 8: The Town shall not be responsible for the theft of any items belonging to park patrons.
SECTION 9: There shall be no use of alcoholic beverages in any park owned by the Town.
SECTION 10: It shall be the responsibility of each individual to maintain cleanliness in the area which they have used. All trash or debris shall be placed in suitable containers provided for such use.
SECTION 11: No park patron shall perform any act which tends to create a danger, hazard, or disturbance to other park patrons.
SECTION 12: No person shall drive any motorized vehicle on any park land, except upon roads or areas which are designated and approved for such purposes. Parking of vehicles shall be permitted in designated parking areas only.
SECTION 13: Use of abusive, upsetting, or threatening language is prohibited.
SECTION 14: Any person, firm, corporation, or entity of any kind who violates any provision of this Chapter shall be subject to § 10.99 of the Town Code for the Town of Leesburg.
