NOTICE OF ENFORCEMENT AUTHORITY ORDER TO JAMES AND DIANNA ELDER AND ALSO TO ANY AND ALL OWNERS OR HOLDERS OF ANY INTEREST IN REAL PROPERTY COMMONLY KNOWN AS
5826 S. WOODLAND LANE, WARSAW, INDIANA 46580

Pursuant to Indiana Code 36-7-9-1 et seq., as adopted by Ordinance #11-11-22-001, James and Dianna Elder was ordered on January 10, 2024 to demolish and remove the unsafe building located on real property situate in Kosciusko County, Indiana, which real property is commonly known as 5826 S. Woodland Lane, Warsaw, Indiana 46580 and legally described as follows:
Lots 18, 19, and 20 Block 1, Maple Gove Beach Unit 7 in Kosciusko County, Indiana.
That the said order was affirmed by the Hearing Authority for Kosciusko County on October 30, 2024, but that the order was not complied with, and that, accordingly, a contract is to be let at public bid to a contractor with all necessary licensing and legal qualifications and who is bonded and insured to accomplish work to comply with the order. That the work to be the demolition and removal of the unsafe building located at 5826 S. Woodland Lane, Warsaw, Indiana 46580, including the complete removal and demolition of the structure there, but excluding removal of concrete slab foundations. The unit shall be disposed of and not moved to another location within Kosciusko County for the purpose of continued use as a structure.
Both the bid price of the contractor who accomplishes the work and an amount representing a reasonable estimate of the cost incurred by the enforcement authority in processing the matter of the unsafe premises may, if not paid, be recorded after a hearing as a lien against all persons having a fee interest, life estate interest, or equitable interest of a contract purchaser in the unsafe premises.
Sealed bids will be received by the Enforcement Authority, the Kosciusko County Health Department, at 100 W. Center Street, Warsaw, Indiana 46580, until 10:00 a.m. prevailing local time on November 14, 2024. All bids will then be publicly opened and read aloud in the third floor old court room in the County Courthouse at 100 W. Center Street, Warsaw, Indiana 46580, on November 14, 2024 at 11:00 a.m.
A copy of the statement of public bid may be obtained from the Enforcement Authority at the Kosciusko County Health Department at 100 W. Center Street, Warsaw, Indiana 46580. Dated: 11/1/2024
