AN ORDINANCE ESTABLISHING VARIOUS FEES AND

PARKING REGULATIONS REGARDING CITY-OWNED ELECTRIC VEHICLE CHARGING STATIONS

Statement of Purpose and Intent

    The purpose and intent of this ordinance is to establish various fees and regulations applicable to the use of City-owned electric vehicle charging stations and associated parking spaces.

    NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of Warsaw, Indiana, as follows:

    Section 1. Chapter 74, entitled Traffic and Vehicles, Article V, entitled Parking, Stopping, and Standing, shall be amended by adding § 74-221 REGULATION OF USE OF PARKING SPACES DESIGNATED FOR ELECTRIC VEHICLE CHARGING, providing as follows:

    § 74-221 REGULATION OF USE OF PARKING SPACES DESIGNATED FOR ELECTRIC VEHICLE CHARGING

    (A) It shall be unlawful to park any non-electric vehicle in a parking space designated for electric vehicle charging.

    (B) It shall be unlawful for an electric vehicle to occupy a parking space designated for electric vehicle charging unless the vehicle is engaged in the charging process.

    (C) Unlawfully parked vehicles in electric vehicle charging spaces are subject to parking fines up to $10.00 for the first hour of parking or any portion thereof beyond the two-hour limit. Unlawfully parked vehicles in electric vehicle charging spaces are subject to Chapter 74 Section 74-218, entitled Towing and Wheel Locks. Towing will occur at the owner's expense.

    Section 2. Chapter 74, entitled Traffic and Vehicles, Article V, entitled Parking, Stopping, and Standing shall be amended by adding § 74-222 FEE FOR USE OF CITY-OWNED ELECTRIC VEHICLE CHARGING STATIONS, providing as follows:

    § 74-222 FEE FOR USE OF CITY-OWNED ELECTRIC VEHICLE CHARGING STATIONS (A) Use of all City-owned electric vehicle charging stations is subject to a flat hourly rate of $2.00 per hour.

    (B) The City's electric vehicle charging stations located on Main St near the Courthouse, and in the City-owned parking lot near the intersection of S Buffalo Street and Jefferson Street were obtained, in pmt, through grant funding from the Indiana Department of Environmental Management under VW Project Funding Agreement Number VWL2-027. As a condition of the City's application for receipt of such grant funds the City agreed to provide the first 2 hours of charging at the grant funded charging stations at no cost to users for the first 2 years after its installation. The grant funded charging stations are to be installed by no later than December 31, 2022. Thus, notwithstanding subsection (A), the City's electric vehicle charging stations no cost through  December  31, 2024.

    Section 3. This ordinance shall become effective after passage, due attestation, and publication as required by law. Further, this ordinance shall remain in effect until amended or repealed by the Common Council.

    THEREFORE; be it ordained by the Common Council of the City of Warsaw, Indiana, with 5 ayes, and 0 nays, and 0 abstentions, that this be Adopted of the City and Resolved this 17th day of October, 2022.
