NOTICE OF A HEARING ON

PROPOSED RATES AND CHARGES

FOR NAPPANEE SEWAGE WORKS

    Property owners and other interested parties in the City of Nappanee are hereby notified that Ordinance No. 1612 establishing rates and charges for services to be rendered by the Sewage Works, was introduced at a meeting of the Common Council held on November 21, 2022.  At a meeting of the Common Council to be held at 7:00 PM on December 5, 2022, in the Nappanee City Hall, there will be a public hearing on the matter of the rates and charges and consideration of adoption of said Ordinance No. 1612, which provides in part as follows:

    SECTION 3.  Sub-section (e) of Section 3 of Ordinance 1521 shall be amended in its entirety as follows:

    Any Regional Sewer District, septic hauler licensed by the Indiana Department of Environmental Management, or other user or entity wishing to discharge wastewater, liquid wastes and/or sewage originating outside the City’s corporate boundaries, directly or indirectly, into the City’s Sewer Works must first make application to the City of Nappanee’s Board of Public Works and Safety. Such application shall be made on such form and contain such information as shall be determined by the City of Nappanee’s Board of Public Works and Safety. Prior to any  such entity or user being allowed to discharge such materials into the Sewage Works, the City’s Board of Works and Public Safety must approve such application, approve a contractual agreement by and between the City and any such user or entity which shall govern the terms and conditions for such discharge and such other terms and conditions deemed necessary and appropriate relative to the relationship of the parties and which shall be in a form and with such terms as the City of Nappanee shall deem acceptable, and such contractual agreement must be executed by the City of Nappanee and all other such users or entities. Any discharge made pursuant to this sub-section (e) shall incur the following charges to be paid by any such user or entity who shall be deemed Contractual Users and are accordingly deemed to be Class 2 users and be further subject to any miscellaneous charges pursuant to Section 5 of this Ordinance.

    $5.75 per 100 cubic feet of waste

    In the event a Contractual User connects to the City’s collection system, a monthly collection system charge shall apply. The collection system charge, which will be established within the contractual agreement, shall be based on the percentage of the City’s collection system that is utilized by the Contractual User.    

    SECTION 4.  Sub-section (e) of Section 4 of Ordinance 1521 shall be amended to add the following sentence to the end of this sub-section:

If a customer does not have an historical average for calculation of a sprinkling rate, 760 CF will be used as the average.

    At such hearing and prior to final adoption of said Ordinance, all interest parties may appear and be heard.  A copy of Ordinance No. 1612 may be examined at the office of the Clerk-Treasurer.
