The State of Indiana to the above person named and any other person who may be concerned.
You are notified that you have been sued in the court above. The nature of the suit is the adoption for the minor child B.L.G., Unknown father of the children born to Samantha Jo Griffin on October 12, 2012, or who claims to be the father of the children born to Samantha Jo Griffin on October 12, 2012, is notified that a petition for adoption of the children was filed in the office of the clerk of court Kosciusko Circuit Court, 121 N Lake St Warsaw, IN 46580.
This summons by publication is specifically directed to the unknown father of B.L.G., whose last known address is unknown.
The Verified Petition filed with the Court will be heard by the Court on or after thirty days from the date of last publication of this Notice. If you know of any lawful reason that the Petition should not be granted, you should file the same in writing with the Court within that thirty-day period. If you fail to file in writing within the thirty days, then the Petition for Adoption being requested by the Petitioners will be granted.
If the unknown father seeks to contest the adoption of the child, he must file a motion to contest the adoption in accordance with IC 31-19-10-1 in the above named court not later than thirty (30) days after the date of service of this notice.
If unknown father does not file a motion to contest the adoption within thirty (30) days after service of this notice, the above named court will hear and determine the petition for adoption. His consent will be irrevocably implied and he will lose his right to contest either the adoption or the validity of his implied consent to the adoption. He will lose his right to establish his paternity of the child, by affidavit or otherwise, in Indiana or any other jurisdiction.
Nothing Samantha Jo Griffin or anyone else says to unknown father relieves unknown father of his obligations under this notice.
Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child’s father. For purposes of this notice, unknown father is a putative father under the laws in Indiana regarding adoption.
This notice complies with IC 31-19-4-5 but does not exhaustively set forth a putative father’s legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes.
