NAPPANEE BOARD OF ZONING APPEALS
The City of Nappanee Board of Zoning Appeals will hold a Public Hearing on Tuesday, June 14, 2022, at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.
The purpose of the Public Hearing is to hear request #03-22-BZA, filed by Rod Stump Jr. at 1250 E. Woodview Drive, Nappanee, Indiana.
The request is for a variance to allow the construction of a new detached garage with a rear setback of 10 feet, where 20 feet is required and a maximum height of 22 feet, where 18 feet is required.
LEGAL DESCRIPTION OF THE PROPERTY:
A part of the Northeast Quarter (NE 1/4) of Section 30, Township 35 North, Range 5 East, Union Township, Elkhart County, Indiana, more particularly described as follows:
Commencing at a stone at the southwest corner of said Quarter Section; thence due East along the South line of said Quarter Section 1, 226 feet for the beginning point of this description; thence North zero (O) degrees 4 minutes East parallel with the East line of the recorded Plat of TOBIAS "WOODSITE" ADDITION (Elkhart County Plat Book 7, Page 47) 300 feet to an iron stake; thence due East 225 feet to an iron stake; thence South zero (0) degrees 4 minutes West 300 feet to the South line of said Quarter Section; thence due West along the South line of said Quarter Section 225 feet to the place of beginning. Subject to easements, restrictions, and public highways of record.
A copy of such proposal is on file in the office of the City Planner of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the City Planner of the City of Nappanee before the hearing will be considered.
All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
