NOTICE OF COMPLAINT TO QUIET TITLE

DONALD R. ZOLMAN AND DARCI ZOLMAN,

HUSBAND AND WIFE, Plaintiffs

v.

THE UNKNOWN HEIRS, LEGATEES AND DEVISEES

OF RUTH E. NICKELS and         ANY PERSONS CLAIMING AN INTEREST IN THE

REAL ESTATE DESCRIBED HEREIN, Defendants

    To the within named Defendants and any persons claiming an interest in the realestate described

    YOU ARE HEREBY NOTIFIED that Plaintiff has filed an action to quiet title to real estate in this matter. The real estate which is the subject of this action is located in Kosciusko County, Indiana and described as follows:

    Land situated in the County of Kosciusko, State of Indiana, is  described as follows:

    North 20 acres of the West 40 acres of the southeast Quarter of Section 27, Township 32 North, Range 6 East. Which said tract of real estate is also described as follows, to-wit:

    A tract of land located in the State of Indiana, County of Kosciusko, Township of Wayne, being  a portion of the Southeast

Quarter of Section 27, Township 32 North, Range 6 East, bounded on the North by the center line of County Road 250 South, on the West by the Packerton Road and more fully described as follows, to-wit:

    Commencing at the Northeast comer of the Southeast Quarter of Section 27, Township 32 North. Range 6 East being an iron pin in the center of County Road 250 South; thence South 0 degrees,14 minutes 40 seconds West, along the East line of said Section, 1,344.65 feet to a railroad iron corner post; thence North 89 degrees 27 minutes  40 seconds West, 571.55 feet to an iron pin located  In the Packerton Road  thence North 1 degree 13 minutes 20 seconds East, along the Packerton Road 591.41 feet to a PK nail; thence North 2 degrees 35 minutes 40 seconds West, 747.92 feet along the Packerton Road to an iron pin located on the North line of the southeast Quarter; thence East along said North line 697.9 feet to the point of beginning, said to contain per deed 20.75 acres of land, more or less.

    AND THE FOLLOWING:

    The West Half (1/2) of the Southwest Quarter (1/4) of Sect on Twenty-six (26), Township Thirty-two (32) North, Range Six (6) East, said to contain per deed, Eighty (80) acres, more or less.

    AND ALSO, all that part of the South Half (1/2) of the Southeast Quarter (1/4) of Section Twenty-seven (27), Township Thirty-two (32) North, Range 6 East, lying East of the public highway running North and south through said Quarter Section, said to contain per deed, Twenty (20) acres, more or less.

    EXCLUDING THE FOLLOWING TRACT:

    Part of the West Half of the Southwest Quarter of Section 26, Township 32 North, Range 6 East, Kosciusko County, Indiana, more particularly described as follows, to-wit:

    Beginning on the North line of said Southwest Quarter,at a point situated 479.3 feet West of the Northeast corner of said West Half; thence West, on and along said North line, being within the right-of-way of County Road 250 South, a distance of 205.0 feet; thence South, by an interior angle of 90 degrees 00 minutes, a distance of 205.0 feet; thence East, by an interior angle of 90 degrees 00 minutes, parallel to said North line, a distance of 205.0 feet; thence North, by an interior angle of 90 degrees 00 minutes,a distance of 205.0 feet to the point of beginning.

    NOTE: The first described tract above has been historically described as the North 20 acres of the West 40 acres of the Southeast Quarter of section 27, Township 32 North, Range 6 East, but is actually the North 20 acres of the East 40 acres of the Southeast Quarter of Section 27, Township 32 North, Range 6 East per the "also described as" description.

    If you claim any interest in the real estate described herein, you or your representative must file a response to Plaintiffs' Complaint within thirty (30) days of the last date of publication  of this notice.  If you fail to so respond, the Court may grant the relief sought by Plaintiffs.
