NOTICE OF PUBLIC HEARING

NAPPANEE BOARD OF ZONING APPEALS

    The City of Nappanee Board of Zoning Appeals will hold a Public Hearing on Tuesday, March 8, 2022, at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    The purpose of the Public Hearing is to hear request #01-22-BZA, filed by Devon Hochstetler of WGGD, LLC.

    The request is for a Variance from the Nappanee Unified Zoning and Subdivision Control Ordinance to allow a non-conforming building with a front setback of 12.5 feet, where 30 feet is required.  The building was constructed without a building permit and approval from the City of Nappanee. The building is 16x22 in size and houses a generator for industrial use.  The generator building is located at 2051 Cheyenne Street, Nappanee, IN 46550.   

    LEGAL DESCRIPTION OF THE PROPERTY: A tract of land located in the Northwest Quarter of Section 35, Township 35 North, Range 4 East, Locke Township, Elkhart County, Indiana, containing 6.53 acres more or less, more particularly described as follows:

    Beginning at a steel monument at the Northeast Corner of the Northwest Quarter of said Section 35, said point being on the centerline of County Road 101; thence South 00 degrees 00 minutes 00 seconds West (assumed bearing), along said road centerline, 729.90 feet to the Point of Beginning; thence continuing South 00 degrees 00 minutes 00 seconds West, along said road centerline, 520.00 feet to a p.k. nail; thence South 89 degrees 59 minutes 58 seconds West, 547.00 feet to a 5/8-inch iron bar; thence North 00 degrees 00 minutes 00 seconds East, 520.00 feet to the South line of a 60' road right-of-way; thence North 89 degrees 59 minutes 58 seconds East, along said road right-of-way, 547.00 feet to the Point of Beginning.

    A copy of such proposal is on file in the office of the City Planner of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the City Planner of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.     

    Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible, but no later than 48 hours before the scheduled event.
