    Notice is hereby given to the citizens of the City of Nappanee, Elkhart and Kosciusko Counties, State of Indiana, that a public hearing will be conducted by the Common Council of the City of Nappanee on a request for tax abatement on both real property and personal property improvement by NEXGEN Group INC and also d/b/a GenY Group.  The real estate which is the subject of such request for real property abatement and upon which the personal property in question is to be located is described as follows:     

    Parcel 1: A PART OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 34 AND PART OF THE WEST HALF OF THE NORTHWEST QUARTER SECTION OF 35, TOWNSHIP 35, NORTH RANGE 4 EAST OF THE 2ND PRINCIPAL MERIDIAN, LOCKE TOWNSHIP, ELKHART COUNTY, INDIANA AS SHOWN ON A SURVEY BY PLYMOUTH LAND SURVEYING AND DESIGN, INC., J.     CONTAINING 9.11 ACRES, MORE OR LESS,SUBJECT TO ALL LEGAL EASEMENTS, RIGHT OF WAYS, CONVENANTS, AND REFERENCES OF RECORD.

    A description of the affected area is also available and can be inspected in the Office of the Elkhart County Assessor, which office is located at 117 N. 2nd Street, Room 204, Goshen, IN 46526, and is also available and can be inspected in the Office of the Clerk-Treasurer of the City of Nappanee, which office is located in the Nappanee Municipal Center, 300 West Lincoln Street, Nappanee, Indiana. A statement of benefits related to the requests for tax abatement as to both the real property and personal property are also on file in the City Clerk-Treasurer’s Office and in the Office of the Elkhart County Assessor.

    The real estate was designated to be an Economic Revitalization Area as that term is defined pursuant to IC 6-1.1-12.1-1 on April 18, 2022, pursuant to Resolution No. 759-22 (the “Resolution”) adopted by the Common Council of the City of Nappanee. A copy of the Resolution with all attachments thereto is available and can be inspected at the office of the Clerk-Treasurer of the City of Nappanee, in the Nappanee Municipal Center, 300 West Lincoln Street, Nappanee, Indiana and in the Office of the Elkhart County Assessor, 117 N. 2nd Street, Room 204, Goshen, IN 46526.

    NEXGEN Group INC/GENY Group has requested that property tax abatement be authorized on the real estate in question for a period of seven (7) years. NEXGEN/GENY has also requested that tax abatement on certain personal property to be located on the real estate be authorized for a period of five (5) years. A determination to preliminarily approve such requests was approved pursuant to the Resolution.

    Said hearing will be held on Monday May 16, 2022, at 7:00 PM in the Council Chambers at the Nappanee Municipal Center, 300 West Lincoln Street, Nappanee, Indiana.

    At such public hearing, persons appearing at such public hearing shall have the right to be heard on the proposed project and the City’s Common Council will receive and hear all remonstrances and objections from interested persons relative to the Resolution and the subject matter thereof. Following such public hearing and the consideration of evidence, the City’s Common Council shall take final action determining whether the qualifications for an economic revitalization area have been met and confirming, modifying, and confirming, or rescinding the Resolution.
