TO SELL CERTAIN TRACTS OF REAL ESTATE
NOTICE IS HEREBY GIVEN that the Town Council of the Town of Winona Lake, Indiana is offering the following tract of real estate for sale. The tract does not have separate assessed value from its parent tract.
The offering price is the amount of $3,000 the tract plus all costs associated with the sale, including but not limited to:
(1) appraisal fees;
(2) title insurance;
(3) recording fees;
(4) advertising costs.
(5) deed preparation and closing costs,
Additional Terms and Conditions are as follows:
(1) The property may not be sold to a person who is ineligible under IC 36-1-11-16; and
(2) An offer to purchase the property submitted by a trust (as defined in IC 30-4-1-1(a))
must identify each:
(A) beneficiary of the trust; and
(B) settlor empowered to revoke or modify the trust.
(3) Offers to purchase the tract shall be submitted in writing to the Town Council by submitting the offer to the Town Coordinator of the Town directly or by delivery to the Office of the Clerk Treasurer of the Town of Winona Lake, Indiana for at 1310 Park Avenue, Winona Lake, Indiana for delivery to the Town Coordinator.
(4) Offers can be submitted for any tract until the tract is sold and all offers are open.
(5) If within ten (10) days after the date of the second publication of this notice, only one abutting landowner makes an eligible offer to purchase the tract then the disposing agent shall offer to negotiate for the sale of the abutting landowner, otherwise the sale will be conducted as provided for by IC 36-1-11-5.
(6) The offering of the tracts for sale may continue for as long as permitted by law, unless earlier terminated by the Town Council or by sale of the tracts.
Description of Tracts Being Offered for Sale
This description, prepared by Aaron J. Carl, Professional Surveyor License Number LS20800123 and employed by T-E Incorporated, was created as part of an Original Survey for Job No. 21036 on June 1, 2021. A part of the Southeast Quarter of Section 15, Township 32 North, Range 6 East, Wayne Township, Kosciusko County, Indiana, also being part of a tract of land conveyed to the Town of Winona Lake by Document 2000010475, all recorded documents in this description are recorded in the Office of the Recorder of Kosciusko County, and more particularly described as follows:
Commencing at the Northwest corner of Lot 17 in Treasure Hills Estates, as recorded in Plat Book 5, page 67, being marked by a 6-inch diameter steel post, also being 0.5 feet North and 0.7 feet West of a stone marking the South Quarter corner of said Section 15; thence North 87 degrees 42 minutes 01 seconds East (being the basis of all bearings this description), on and along the North line of Lots 17-21 in said Treasure Hills Estates, a distance of 406.61 feet to the Northeast corner of said Lot 21, being marked by a 5/8-inch diameter rebar with an identification cap stamped “T-E INC FIRM ID #0070” (from herein referred to as “T-E Cap”); thence South 00 degrees 35 minutes 45 seconds East, on and along the East line of said Lot 21, a distance of 4.98 feet to the South line of said Southeast Quarter, being marked by a “T-E Cap”; thence North 88 degrees 20 minutes 03 seconds East, on and along said South line of the Southeast Quarter, a distance of 742.79 feet to the Southwest corner of a tract of land conveyed to Grace Schools, Inc. by Deed Book 299, page 597, being marked by a “T-E Cap”; thence on and along the West line of said Grace Schools, Inc. tract for the following 3 courses: thence North 00 degrees 33 minutes 04 seconds West, a distance of 225.77 feet to the Point of Beginning, being marked by a “T-E Cap”; thence North 28 degrees 59 minutes 54 seconds West, a distance of 252.00 feet to a “T-E Cap”; thence South 88 degrees 14 minutes 19 seconds West, a distance of 80.00 feet to a “T-E Cap”; thence South 00 degrees 39 minutes 34 seconds East, a distance of 224.05 feet to a “T-E Cap”; thence North 88 degrees 15 minutes 16 seconds East, a distance of 199.64 feet to the Point of Beginning, containing 0.719 acres of land more or less, being subject to and/or together with all easements and rights-of-way of record.
The foregoing tracts are subject to all easements and encumbrances of record or ascertainable by survey. The foregoing tract is not believed to be accessible by any street, road or other way, and no access is provided.
