Leesburg Man Arrested On Rape, Incest Charges

Joshua Allen Bammel, 39, of 2992 E. Armstrong Road, Leesburg, is charged with rape, a Level 3 felony; and incest, a Level 5 felony.
Bammel was booked into the Kosciusko County Jail at 1:55 p.m. Monday and has a $20,250 bond.
According to the probable cause affidavit, on Aug. 11 Kosciusko County Sherriff’s Office deputies responded to a report of a rape that allegedly occurred Aug. 9, 2020.
Deputies spoke to the victim, who said she had been in a tent outside a residence. She said she consumed alcoholic beverages earlier that day on Aug. 9, 2020, and fell asleep on a cot in the tent around 8 p.m.
The victim said she woke up around midnight Aug. 10, 2020, and noticed an odor and wetness from her groin area upon waking up, according to court documents. The victim said she had lower abdominal pain and showed deputies a bruise on her right thigh. The victim said she doesn’t have any memory of anything from when she fell asleep until she woke up around midnight.
The victim said she believed Bammel had sex with her without her consent. The victim alleged Bammel told her in the past, he was going to have sex with her someday, according to court documents. Bammel is a registered sex offender.
The victim submitted to a forensic exam at the Sexual Assault Treatment Center in Fort Wayne on Aug. 11, 2020. During the forensic exam, injuries were noted as bruises to her right thigh, visible redness and bruising and injury to her genitals. The sexual assault kit was collected and submitted to the Indiana State Police Laboratory for examination. The laboratory reported the presence of an unknown male’s DNA on the submitted samples, according to court documents.
On Dec. 9, 2020, Bammel agreed to speak with deputies about the incident. Deputies informed Bammel he was identified as a suspect in the case and asked Bammel if he was aware of the incident. Bammel said he wasn’t.
Deputies explained the allegations to Bammel. According to court documents, Bammel said, “I don’t even remember that night. We were both f***ed up.”
Deputies hadn’t mentioned when or where the incident took place. Bammel was read his Pirtle rights, and Bammel signed the form, acknowledging his understanding of those rights. Bammel was asked to provide a DNA sample for comparison with the samples from the sexual assault kit. Bammel consented.
On Jan. 8, 2021, the ISP Laboratory reported the swabs from the victim contained DNA at least 1 trillion times more likely if it originated from the victim and Bammel than from the victim and an unrelated individual.
