    Notice Is Hereby Given,  That The Kosciusko County Area Plan Commission Shall Hold A Public Hearing On

    A Petition Filed by George E. Tubbs. Requesting An Amendment To the Kosciusko County Zoning Ordinance, To Reclassify From an: Industrial 2 District to an Commercial District,

    The Following  Real Estate,  located on

    And Described As Follows  on the 2nd page, To Wit:

Part of the Southwest  Quarter of Section 13, Township 32 North, Range 6 East, Kosciusko County, Indiana, (containing part of Elaine Drive as shown 6n the recorded Plat of Marathon Industrial  Park, as recorded in Plat Book 7, page 83, of the records of Kosciusko County, Indiana), more particularly described as follows, to wit:

along the Westerly  right-of-way line of said Elaine Drive, a distance of 102.0 feet to an iron pin found at the

true point  of beginning; thence continuing S 16° 57 1W, on and along said East line and said Westerly right-of-way line, a distance of 361.1 feet to an iron pipe found at the point  of intersection with the Northerly  right-of-way line of U.S. Highway Number 30; thence S 70" 25 1E, on and along said northerly right-of-way line, a distance of 100.0 feet to an iron pin; thence N 16" 57 E, a distance of 336.22 feet to an iron pip on a Southwesterly line of a certain tract of land as recorded in Deed Record 339, page 374, in said records; thence N 33" 111W (recorded N 33° 03 1W), on and along said Southwesterly line, a distance of 28.13 feet to an iron pin at a corner of said tract  of land as recorded in Deed Record 339,page 374; thence N 73" 05 143" W, on and along a Southwesterly line of said tract of land as recorded in Deed Record 339, page 374,a distance of 28.33 feet to a Southwesterly corner of said tract of land as recorded in Deed Record 339, page 374; thence N 60" 07 45 W, a distance  of 51.27 feet to the true point  of beginning, containing 0.809 acres of land, more or less, subject to all legal right-of-way, subject to an easement for a legal drain which crosses the Northerly  part of the above described tract, subject to all other easements of record and the above described 0.809 acre tract also being subject to an non-exclusive ingress, egress and utility easement over, under and across the Southwest  50 feet of the above described tract.     This Change Is Requested To Permit the Above Described Real Estate to Be Used For The Purpose of Commercial Uses as defined in the Kosciusko County Zoning Ordinance.

    This Hearing Will Be Held in the: Commissioner's Meeting  Room, County Court House 100 W Center St., Warsaw On 01/05/2022  At 1:00 P.M.
