BE IT KNOWN, that The Bank of New York Mellon Trust Company, NA, fka The Bank of New York Trust Company, NA, as successor to JPMorgan Chase Bank, NA, as trustee, in trust for the Holders of Truman Mortgage Loan Trust 2002-1, Asset-Backed Certificates, Series 2002-1, the above-named Plaintiff, by its attorney, J. Dustin Smith, has filed in the office of the Clerk of the Kosciusko Superior Court #3 its Complaint against Defendant The Unknown heirs, devisees, legatees, beneficiaries of Thomas V. Buskirk and their unknown creditors; and the unknown executor, administrator, or personal representative of the Estate of Thomas V. Buskirk, and the said Plaintiff having also filed in said Clerk’s office the affidavit of a competent person showing that the residence and whereabouts of the Defendant, The Unknown heirs, devisees, legatees, beneficiaries of Thomas V. Buskirk and their unknown creditors; and the unknown executor, administrator, or personal representative of the Estate of Thomas V. Buskirk, upon diligent inquiry is unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Kosciusko County, State of Indiana, to wit:
Lot Number Eleven (11) in Herscher's 8th Addition, near Warsaw, less and excepting therefrom the following described tract:
Commencing at the Southwest corner of said Lot Number 11 in Herscher's 8th Addition; running thence North 00 degrees 36 minutes 53 seconds East, along the West line of said Lot 11, 30.57 feet; thence South 89 degrees 27 minutes 34 seconds East, 25.40 feet; thence South 00 degrees 36 minutes 53 second West 30.57 feet; thence North 89 degrees 27 minutes 34 seconds West 25.40 feet to the place of beginning.
Including that manufactured home more specifically described as a 1974 Shamrock mobile/manufactured home.
commonly known as 200 Leedy Street, Warsaw, IN 46580.
NOW, THEREFORE, said Defendant is hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendant for the relief demanded in the Complaint.
