The alcohol license renewal for Pierceton Discount Liquors was tabled Thursday until the Sept. 2 Kosciusko County Alcohol and Tobacco Commission (ATC) hearing because not enough information was known about a violation.

Scotts Package Liquors Inc., doing business as Pierceton Discount Liquors, 101 S. First St., Pierceton, had its beer, wine and liquor license for a package store up for renewal Thursday.

Christopher Geiger, general manager for the business, said he didn’t remember exactly when the violation was as he never received a citation. A former employee received her citation.

“I’m assuming that the citation got mailed to the previous owner’s address, and so I never received it. She has passed away,” he said.

Geiger estimated that the violation happened about three to four months ago when the former employee sold alcohol to a minor.

County ATC member Alan Alderfer asked for a clarification on what Geiger meant when he said the owner has changed.

“The owner has passed away. Currently, the estate and the company is being split up by an executor. So, currently, there is no owner. There is a future owner, the daughter of the owner is in line to get the permit,” Geiger said.

Alderfer asked him if he was the general manager when the violation happened, and Geiger said yes and the employee that sold alcohol to a minor is no longer employed there.

“But you don’t know because you haven’t gotten any paperwork on it? You don’t know if there was a fine?” excise officer and ATC member April Tackett asked Geiger.

He said for the store he did not know. The only thing he had seen was the citation the former employee received because she brought it in for him to see.

Tackett said they couldn’t hear the renewal with a violation without knowing if the fine has been paid and if it has been through the prosecutor’s office. Geiger said it “definitely” has not been paid, but he wasn’t sure who he needed to reach out to in order to take care of the violation. Tackett suggested tabling the renewal until September for Geiger and her to figure out more details about the violations.

She then asked Geiger about the history of the store regarding violations. He told her he has worked there since January 2017 and this was the first actual citation. He believed they received a warning once, but no actual citation.

Dan Woods, ATC member, made a motion to table the renewal until the Sept. 2 hearing to get it straightened out. The motion was unanimously approved. Tackett told Geiger either he or another representative of the business will need to appear at that hearing.

Five alcohol license transfers for Pizza King were unanimously approved. The licenses included a beer and wine retailer – restaurant permit for Pizza King at 806 N. Jefferson St., Silver Lake; beer and wine retailer – restaurant permit for Pizza King, 1039 Winona Ave., Warsaw; beer retailer – restaurant for Pizza King, 1727 W. Lake St., Warsaw; beer, wine and liquor – restaurant for Pizza King, 1727 W. Lake St., Warsaw; and a beer and wine retailer – restaurant permit for Pizza King, 719 Huntington St., Syracuse.

There were no remonstrators.

Troy McKee, Pizza King director of operations for the northern territory, said beer and wine is not a huge part of their sales, just something they carry for the customers who want it. He said he’s been doing it for 14 years and none of his restaurants have any violations. He confirmed the Pizza Kings were formerly franchise-owned and now they’re company-owned.

Alderfer moved to approve all five transfers and the motion passed 4-0.

Two new license applications before the County ATC Thursday was for George’s Highlander, 204 E. State St., Etna Green, owned by Angela Faulkner and Lyle Faulkner II. The permits are for a beer and wine retailer – restaurant and a beer, wine and liquor – restaurant.

Tackett explained, “This is one of those permits where though there are two permits, it’s one place. You have to have the underlying permit to get the liquor portion of it. So, that’s why there’s two there.”

Lyle said the old alcohol license for the business was “tied up in taxes or it wasn’t available to transfer,” so that’s why they were applying for a new license. “Once that gets cleaned up, hopefully I can get my hands on that old license so we can have carryout. It was a four-way.”

Though the County ATC voted unanimously in favor of the new permits, the Indiana ATC will have to give final approval on them. Tackett estimated the state wouldn’t hear them until Aug. 17.

License renewals without violations approved by the County ATC included:

• Dollar General Store, 521 S. 1st St., Pierceton, beer and wine dealer, grocery store.

• Dollar General Store, 6772 N. Ind. 13, North Webster, beer and wine dealer, grocery store.

• Channel Marker Restaurant, 5793 E. Pickwick Road, Syracuse, beer, wine and liquor, restaurant.

• Kroger, 2211 E. Center St., Warsaw, beer, wine and liquor, drug store.

• New Market #770, 726 S. Huntington St., Syracuse, beer and wine dealer, grocery store.

• Louie’s Bar and Grill, 209 E. Bowser Road, Syracuse, beer, wine and liquor, restaurant.

• The Post, 13496 N. First St., Pierceton, beer, wine and liquor, restaurant.

• Texas Roadhouse, 700 W. CR 300N, Warsaw, beer, wine and liquor, restaurant.

• Wawasee Bowling Lanes, 1201 S. Huntington St., Syracuse, beer, wine and liquor, restaurant.
