NOTICE OF PUBLIC HEARING

NAPPANEE CITY PLAN COMMISSION

    The City of Nappanee Plan Commission will hold a Public Hearing Thursday, May 13, 2021 at 7:00 p.m. in the Council Chambers at the Nappanee City Municipal Center, 300 W. Lincoln St., Nappanee, Indiana. The purpose of this hearing is to hear the following rezoning request filed by My Fathers Land, Thomas Mast, owner 257 Haney Dr. Nappanee, IN 46550 for property located at 1054 N. Main St. Nappanee, IN 46550.

    The request is to change the current zoning of R-1, (Low Density Residential) to B-2 (General Business) with respect to the following described real estate, to wit:

    LEGAL DESCRIPTION OF PROPERTY:  

    REAL ESTATE

    A tract of land in the Southeast Quarter of Section 25, Township 35 North, Range 4 East, Locke Township, Elkhart County, Indiana, more particularly described as follows:

    Commencing at a Harrison Monument at the Southeast corner of the Southeast Quarter of Section 25; thence North 00°28'46" West (basis of bearings established by INDOT VRS Base, using NAD83 Indiana East coordinate system), along the East line of said Southeast Quarter and within the right-of-way of State Road 19, 285.00 feet to the Point of Beginning; thence North 88°50'10" West, 172.54 feet (recorded 173.25 feet) to a Doriot cap pin; thence South 00°00'05" East, 87.89 feet (recorded 87.00 feet) to a Doriot cap pin; thence North 89°08'14" West, 131.65 feet (recorded 133.73 feet); thence North 01°06'05" West, 191.00 feet to a point 0.9 feet West and 0.3 feet North of a railroad iron; thence South 89°08'14" East, 306.98 feet to a point on said East line; thence South 00°28'46" East, 104.00 feet to the Point of Beginning, containing 0.99 acres more or less.

    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana. Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary. Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112,[email protected] as soon as possible but no later than 48 hours before the scheduled event.

    In light of COVID-19 the City of Nappanee Plan Commission will also hold this public hearing via teleconference/video. Access to this information will be available by contacting the Nappanee Planning Department at least 48 hours prior to the meeting.
