Lease of Non-Roadway Portion of South Elm

Street Right-of-Way

    The City of Nappanee (“City”), through its Board of Public Works and Safety (the “Board”) has determined that it would be appropriate to pursue the possibility of entering into a lease a certain part of non-roadway portion of the City of Nappanee’s South Elm Street road right-of-way, more specifically described  as:

    The West Ten (10) feet and Ten (10) inches of the Sixty-six (66) feet wide public right-of-way known as E. Elm Street in the City of Nappanee, Indiana, running North and South, parallel and adjacent to the entire East side of Lot Number Thirty-four (34) as the same is known and designated on the recorded Original Plat of the Town of Nappanee, Elkhart County, Indiana; said Plat being recorded in Deed Record 48, page 280 of the records in the Office of the Recorder of Elkhart County, State of Indiana.

    The purpose of the lease is to provide parking for an interested tenant.  Rather than pursuing the rental of the Subject Real Estate pursuant to the provisions of I.C. 36-1-11-10, the Board has determined that the use of I.C. 36-1-11-10 is not feasible in regard to the Subject Real Estate and toward that end, the Board  adopted at its meeting on July 27, 2020, a written determination to lease the Subject Real Estate pursuant to I.C 36-1-11-12.  Also as required by I.C. 36-1-11-12, the City’s Mayor, as the City’s Chief Executive, has authorized the use of I.C. 36-1-11-12 with regard to the Subject Real Estate.
