CAUSE NO. 43D01-2010-DC-274
The Court having received a pro se Petition for Dissolution of Marriage, now enters the following order.
1. No preliminary or final hearing will be set by the Court until a written request for hearing is made by one of the parties. This request must include your name, address, telephone number and case number. You must also notify the Court if your address changes at any time.
2. Indiana law requires a minimum of sixty (60) days after the petition is filed before a Dissolution Decree may be issued.
3. The Court will not automatically issue a Decree after the sixty (60) days has elapsed. The Petitioner must request a final hearing date, or file with the court the following:
a. Verification that both parties have completed the Trans-Parenting Program where minor children are involved.
b. waiver of Final Hearing signed by both parties.
c. Proof that the Respondent was properly served with summons.
d. A property Settlement Agreement signed by both parties.
e. If applicable, a custody, child support and parenting time agreement signed by both parties, including an Indiana Child Support Obligation Worksheet.
f. A proposed Decree of Dissolution of Marriage.
4. If the Petitioner and Respondent have dependent children, there is an educational program, "Trans-Parenting," at the Bowen Center. Parents are not required to attend together or with their children, but do need to attend within 60 days of this filing. Please present this letter or copy of your Court Order with your case number to the Bowen Center for their records. To get information about the program times and fees, please call 574-267-7169.
5. Please do not ask the court staff for legal advice. The Court staff is not allowed to give legal advice to the parties. The judge is not allowed by the Code of Ethics to discuss the case with one party without the other party being present in open court.
