NOTICE OF PUBLIC HEARING WITH REGARD TO PETITION TO VACATE

PUBLIC WAY IN INCORPORATED CITY OF NAPPANEE, INDIANA

    A Petition has been filed with the City of Nappanee, Indiana seeking to have vacated a certain public way within the incorporated area of the City of Nappanee, Indiana, which public way is more particularly described as follows:

    A 16.5 FOOT WIDE ALLEY ADJACENT TO LOTS 45,46,49, AND 50, “ORIGINAL PLAT OF NAPPANEE (ALSO KNOWN AS CULPS ADDITION TO THE ORIGINAL PLAT OF THE TOWN, NOW NAPPANEE)”, BEING A SUBDIVISION IN PART OF THE SOUTHWEST QUARTER OF SECTION 31, TOWNSHIP 35 NORTH, RANGE 5 EAST, CITY OF NAPPANEE, ELKHART COUNTY, INDIANA, ACCORDING TO THE PLAT THEREOF RECORDED IN RECORD 48, PAGE 280 IN THE OFFICE OF THE RECORDER OF ELKHART COUNTY, INDIANA, DESCRIBED AS: BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 46; THENCE SOUTH 89º 35’ 52” EAST ON THE NORTH LINE OF SAID LOT 46 EXTENDED 16.50 FEET TO THE NORTHWEST CORNER OF SAID LOT 45; THENCE SOUTH 00º 24’ 25” WEST ON THE WEST LINE OF SAID LOTS 45 AND 50 A DISTANCE OF 103.80 FEET TO THE SOUTHWEST CORNER OF SAID LOT 50; THEN NORTH 84º 06’ 46” WEST ON THE SOUTH LINE OF SAID LOT 50 EXTENDED 16.58 FEET TO THE SOUTHWEST CORNER OF SAID LOT 49; THENCE NORTH 00º 24’ 25” EAST ON THE EAST LINE OF SAID LOTS 49 AND 46 A DISTANCE OF 102.21 FEET TO THE POINT OF BEGINNING.  CONTAINING .039 OF AN ACRE MORE OR LESS.

    The Nappanee Common Council will meet on Monday, May 18th, at 7:00 PM. Due to the coronavirus and the Indiana Governor’s Executive Orders 20-08 and 20-09, this meeting will be a virtual meeting. The tentative agenda will be posted by Friday, May 15th. If you would like to observe the meeting or wish to comment on any item, please email or call City Clerk-Treasurer at [email protected] or 574-773-2112 at least one (1) hour before the meeting. "Request to speak" cards can be found at www.nappanee.org.

     A public hearing has been scheduled before the Common Council of the City of Nappanee, Indiana with regard to such Petition on the 18th day of May, 2020 at 7:00 o’clock P.M. during the virtual meeting. The Common Council of the City of Nappanee, Indiana will conduct a public hearing with regard to such Petition and will consider all public comments with regard to the requested public way vacation.  All persons interested in, or affected by, said proposed vacation of said public way may observe the virtual meeting and the public hearing, may speak in favor of said Petition, or may remonstrate against the Petition, as provided by law in accordance with the instructions above for the virtual meeting.  Following the public hearing, the Common Council of the City of Nappanee, Indiana may act upon the Petition.
